KNOW ALL MEN BY THESE PRESENTS, that Donald F. Shoemaker and
Annabel Shoemaker, 4500 Robb Street, Wheat Ridge, of Jefferson
county, State of Colorado, hereinafter called the "grantor (s)"
for and in consideration of the sum of Ten & 00/100 dollars
($10.00) and other valuable consideration to in hand paid by the
City of Wheat Ridge, hereinafter called "City", do hereby give
and grant to said City PERMANENT RIGHT-OF-WAY AND EASEMENT on,
along, over and across the following described premises to-wit:
A ten (10) foot wide tract of land which is located along the
north boundary of a tract of land described as follows:

The North 263 feet of the following tract of land described
as: The West 1/2 of the Northeast 1/4 of the Southwest 1/4
of the Northwest 1/4 (W 1/2 NE 1/4 SW 1/4 NW 1/4) of Section
21, Township 3 South, Range 69 West of the 6th P.M., EXCEPT
rights of way of record or in ease; and conveying hereby
water rights appertaining or belonging to the land hereby
conveyed, said water rights being represented by four (4)
shares of Capital Stock of the Brown & Baugh Ditch Company.
The tract herein containing two (2) acres, more or less,
except rights of way for ditches and public highways now of
record or existing.
Also known as street and number: 4500 Robb Street

For the purpose of constructing and maintaining a drainage system
for stormwater run-off.
Subject to the following terms and conditions:
Following construction, the easement area shall be restored
to original condition or better. Excess spoil shall be
placed on the easement area and levelled. Existing
irrigation ditch on the north and west sides of property to
be reconstructed to original condition.
And the Grantors hereby covenant with the Grantee that they have
good title to the aforedescribed premises; that they have good
and lawful right to grant this easement.
