KNOW ALL MEN BY THESE PRESENTS, that Ray C. Pepe and Nita G. Pepe, whose legal address 3390
Teller Street, City of Wheat Ridge, County of Jefferson, Srate of Colorado 80033, hereinafter called the "Gran-
tors" for and in consideration of the sum of TEN and NOli 00 ($10 00) and other valuable consideration to them
in hand paid by the City of Wheat Ridge, heremafter called "City", do hereby give and grant to said City
PERMANENT EASEMENT on, along. over and across the following described premises to-wit
A tract of land lying in the NE I:' of Se~tion 26. T owns hi; 3 SG:lth, Range 69 \Vest of th.e 6th Pr1.t1.cipal
Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, as described at Reception
Number 93188253 in the official records of the County ofJefferson, State of Colorado
Commencing at the Northeast Corner of Section 26, thence S00024'51 "E on and along the east line of the NE'l. of
Section 26, a distance of 1,610 14 feet; thence S8903S'09"W, a distance of 1 ,262.17 feet to a Point, said Point lying
on the southerly Right-of-Way line of West 34th Place. the northeasterly corner of said parcel found at Reception
Number 93188253, and also being the True Point of Beginning;
Thence S04044'35"W on and along the easterly line of said Parcel, a distance of2.17 feet; thence N83024'20"W, a
distance of94.20 feet to a Point, said Poinr lying on the easterly Right-of-Way line of Teller Street and also being
the point of curvature of a non tangent curve to the nght, of which the radius point lies S44027'52"E, a radial dis-
tance of 15.00 feet; thence easterly along the arc, through a central angle of 53027'26", a distance of 1400 feet, to a
point lying on the southerly Right-of-Way line of West 34th Place; thence S81 001 '56"E on and along said southerly
Right-of-Way line, a distance of 81 91 feet to the True Point of Beginning.
NOTE: All bearings are relative to one another and arc based on the bearing of the East line of the NE V. of said
Section 26 being S 00024'51" E.
For the purpose of; The construction and maintenance of a Sidewalk.
Subject to the following terms and conditions: Tv the extent pennitted by law, and Without waiving any immunities,
prutections, or defenses available at common law or under stature, including, without limitation, the Colorado Gov-
emmental lmmuniUes Act, Section 24-IU-lUl, et seq., CR.S., the City, individually and for itself only, agrees to
hold harmless the Grantors from and against any suit, claim, attorney's fees, loss or damage, including personal in-
jury or loss of life, which may occur as a result of negligent construction or maintenance of said sidewalk by and/or
for the City on the property subject to this easement.
Said tract contains 365 square feet or 0 0084 acres, more or less.
Also known by street and number as: 3390 Teller Street, Wheat Ridge, Colorado, 80033
And the Grantors hereby covenant with the City that they have good title to the afore described premises; and that
they have good and lawful right to grant this easement.
