AN ORDINANCE-VACATING' A CERTAIN PART OF A STREET.LOCATED - WITHIN THE CITY OF WHEAT RIDGE: I.C. VACATING A CERTAIN DESCRIBED BEET LYING IN PART OF THE SOUTHEAST ONE-QUARTER -OF THE SOUTHWEST ONE-QUARTER OF THE SOUTHWEST ONE-QUARTER- OF_SECTION 14, TOWNSHIP 3 SOUTH, RANGE 69 WEST OFTHE 6TH Principal Meridian. WHEREAS, by a deed recorded in Book 445 at Page 95, Book 447 at Page 554, and Book 453 at Page 318, of the Jefferson County Records, a certain street was-dedicated to the public, and WHEREAS, the following described street - necessary for use by the public; and WHEREAS;_said street swithin the limits of the City-of Wheat Ridge; and WHEREAS, no -land would, by a vacation of said street be left without an, public road connecting it with another established public road;-and - WHEREAS, the Wheat Ridge Planning Commission has approved the vacation-of said street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT'RIDGE, COLORADO, THAT: Section 1. The following described street in the City of Wheat Ridge, Colorado, be vacated, to wit: That part of the Southeast one-quarter of the Southwest one-quarter of the Southwest one-quarter of Section 14, Township 3 South, Range 69 West of the 6th Principal Meridian, described as follows: -Beginning at the South- east corner of the Southwest one-quarter-of the South- west one-quarter of said Section 14; thence east along the south line of_said -Section 14 a distance of 30 feet; thence North to the southerly_ line of property described RECEPTION N0. 87073691 in deed recorded in Book 1132 at Page 193 a distance of 250 feet more or less.; thence Southwesterly along the Southerly line of said property described in Book 1132 at page 193 a distance of 31 feet more or less to a_point on the East line of said Southwest one- quarter of the Southwest one-quarter of said Section 14; thence South along said East.line of the South- west one-quarter of the Southwest one-quarter of Section 14.a distance of 248.9 feet to the point of beginning. And the same is hereby approved and the described street ishereby vacated;- provided, however, said vacation shall be subject tothe following conditions and reservations: There is reserved to.,the-Cityof-Wheat Ridge and to utility owners the continued use and right to construct, operate, and maintain sewer, power, telephone, and gas linen in said vacated street. Section 2. Emergency Clause. The provisions-of this ordinance are necessary to the immediate preservation of the public health and safety of the citizens of the City of Wheat Ridge for the following reasons: 1. No ordinance has been- previously passed relating,to the vacation of this street because the City having just completed incorporation August 20, 1969, has not heretofore adopted any ordinances vacating this street. 2. An ordinance vacating this street-is necessary to allow the. orderly development of this area. Section 3. Effective Date. This ordinance-shall take effect and be in force five (5) days-.after publication following.--_ final passage-providing it shall have been passed by an affirmative vote of three-fourths (3/4) of themembers of the City Council;. otherwise, said ordinance shall take effect thirty(30) days after publication following final passage. - 2 - RECEPTION NO. 87073691 INTRODUCED, READ, ADOPTED AND ORDERED_PUBLISHE.D.AND POSTED this SR6rl~ day of on first reading by a vote--Of _5- to MA 2--C A, D 1970.
