Series of 1970 TITLE: AN ORDINANCE PERTAINING TO THE GROWTH, ACCUMULATION AND CUTTING OF WEEDS: THE ABATEMENT THEREOF; THE MANNER OF COLLECTIVE COSTS ASSOCIATED WITH SAID ABATEMENT; PENALTIES.FOR VIOLATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CI,TY,OF WHEAT-RIDGE, COLORADO, THAT: Section 1. Growth and-Accumulation on Premises and Adjoining Sidewalks and Alleys Prohibited. It shall be the duty of every-owner of an open area, or any tenant or agent in.charge thereof, as that term is herein defined, to cut or cause-to be, cut or destroyed all_weeda igeexcess,Of eighteen ,(18) inches in height growing thereon and to remove the weeds so cut, to some place where refuse ia.ordinarily disposed of. An open area is defined as any area, in single or joint ownership which is less than five (5) acres, or an area of any size which lies within one hundred feet (1001) of__ary. developed area, platted street or existing thoroughfare. The.term_"weeds" shall mean weeds, grass, brush or other rank or noxious vegetation and shall not include flower gardens, plots of shrubbery, vegetable gardens and small grain plots. Section 2. Abatement by City. If any owner, tenant or agent in charge shall fail to- cut weeds, as requirad by this section, within five (5) days after being notified to _do _so by the Mayor or his designated representative, by registered or k certified mail, the City Council may direct that the weeds be cut and charge the cost thereof to such owner, tenant or agent in charge, together with five per cent (5%) additional for inspection and other incidentals. e c E k G c. Section 3. Collection of Costs of Abatement by City. (a) In the event the weeds on any lot, block or parcel of ground, or along the sidewalk adjoining the same or the alley behind the same, are out by order of the City Council, the whole cost of cutting such weeds, together with five per cent (5%) for inspection and other • incidentals, shall be paid to the City Treasurer within thirty (30) days after mailing by the city Treasurer to the owner of such lot, block or parcel of ground, by registered.pr certified mail, notice of the assessment of such cost. (b) Failure to pay such assessment_within such period ❑f thirty (30) days shall cause such assessment to become a lien against such lot, block or parcel of land and shall have priority over all liens, except general taxes and prior special assessments, and the same may he certified at any time, after such failure to so pay the same, within thirty (30) days, by the city Clerk to the county treasurer to be placed upon the tax list for the current year and to be collected in the same manner as other taxes are collected,, with ten per cent (10%) penalty to defray the cost of collection. Section 4. Penalty for violation of chapter. Any person who violates any provision of this ordinance shall he guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding three hundred dollars ($30x•00) or by imprisonment for a period not exceeding ninety (90) days, or both such fine and imprisonment. Every day of such violation shall constitute a separate offense. Section 5. Effective Date. This ordinance shall take effect and be in force five (5) days after publication following final passage; providing it shall have been passed by an affirma- tive vote of three-fourths (3/4)_of the members of the City Council; otherwise, said ordinance shall take effect thirty (30) days after publication following final passage. Section 6. Emergency Clause. The provisions of this ordinance are necessary"for the immediate preservation of the public health, safety, and welfare of the City for the following reasons: 4 t. . 1. No ordinance has been previously passed relating to the-growth,__accumulation, cutting and control of weeds. 2. No ordinance,has-been passed previously as the City completed incorporation August 20, 1969, and no ordinances relating to the ,growth, accumu- lation, cutting and control of weeds existed-at this time; and the City has not yet had an oppor- tunity to pass such an ordinance relating to the - growth, accumulation, cutting, and control of weeds. - - INTRODUCED, READ, ADOPTED AND ORDERED PUBLISHED AND POSTED on first reading by a vote Of 6 to 0 this 23rd day of July , A.
