HomeMy WebLinkAboutOrdinance-1972-0107 - Amend WR Ord 10 regarding Fire CodeIntroduced by Alderman Ray C Pepe ORDINANCE NO.' 107 Series of 1972 v'...~ L TITLE: AN ORDINANCE TO AMEND ORDINANCE__NO._10_OF_THE CITY OF WHEAT RIDGE BY REPEALING CERTAIN PORTIONS OF SAID ORDINANCE PERTAINING TO A FIRE CODE ADOPTED AS PART OF THE BUILDING CODE OF THE CITY OF WHEAT RIDGE AND ADOPTING A REVISED FIRE CODE; SAID FIRE CODE BEING ADOPTED AS A PRIMARY CODE IS THE UNIFORM FIRE CODE, 1971 EDITION, PROMULGATED BY THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND THE WESTERN FIRE CHIEF ASSOCIATION, AND TO SET OUT WITHIN SAID FIRE CDDE CERTAIN PROVISIONS RELATING TO VOLUNTARY FIRE COMPANIES OR OTHERWISE, AND TO ESTABLISH THE POWERS AND DUTIES OF THE MEMBERS OF THE FIRE DEPARTMENT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section l.- Repeal of American Insurance Association Fire -_Code-. The Fire Code adopted by Section l of Ordinance No. 10 and known as The Fire Prevention Code, 1965 Edition CRecom= mended by American Insurance Association) is hereby repealed. Section 2. Adoption of Fire Code The Uniform Fire Code, 1971 Edition, as promulgated by the International Confer- ence of Building Officials, 50 South Los Robles, Pasadena, California 91106, and the Western Fire Chiefs Association, Post Office Box ,842, San Leandro, California 94577, is hereby adopted in full save and except those portions as are herein- after deleted, modified or amended by Section 6 of this Ordinance. Section 3_. Enforcement of Fire Code. The Uniform Fire Code shall be enforced by the Chief Building Inspector of the City and his designated assistants. In addition the Fire Code shall be enforced by the Bureau of Fire Prevention of the Wheat Ridge Fire Department (Wheat Ridge Fire Protection District) under direction of the Chief of the Fire District. Section 4. Definition. Whenever the word "jurisdic- tion" is used in the Uniform Fire Code, it shall be held to mean that area included within the corporate limits of the City of Wheat Ridge or any area hereafter annexed to the City. Section 5. Permits.. Wherever the Fire Code allows or requires a permit to be issued, the applicant shall apply for the permit to the City of Wheat Ridge ❑n a form supplied by the City for that purpose and accompanied by a fee in the amount of $10.00. Said permit shall be issued by the Mayor upon approval of the Fire Chiefand Chief Building Inspector upon a showing that the applicant meet"s'all requirements as set out as being necessary by the Fire Code. i Section 6. -Deletion, modification or amendments to the Uniform Fire Code, 1971 Edition. a. Sec. 1.211 shall be amended by the addition of the following sentences: "Certified mail may be used in place of registered mail. _ Service may be made as set out in the Colorado Rules of Civil-Procedure." b. Sec. 1.215 shall be deleted and in its place the following sentences shall-be added; - "In order to determine the.suitability of alternate materials and type of construction and to provide rasscnable interpretation of the provisions of this Code, the Building Code Advisory Committee, previously established by Ordinance 10-of-the City shall have authority to hear and decide those matters delegated to it, and all matters requiring use_of -a Board of Appeals by this Fire Code." c. Section 1.405. The definition of Chief or Chief of the Fire Department shall be defined in the fallowing manner-in place of that definition set out in the Cade: "Chief or Chief of the Fire Department shall mean.the Chief of the Wheat Ridge Fire Department-as authorized by the Directors of the Wheat Ridge Fire Protection District." d. Section 1.408. The definition of Fire Department shall be defined in the following manner in place of that definition as set-out in the Code: "Fire Department shall mean the Wheat Ridge Fire.Department administered by the Directors of the Wheat Ridge Fire Protection District.'! e. Section 3.104. Burning Operations, shall be deleted in full and the following shall be adapted in its place: "Section 3.104. The burning of-wrecked or discarded motor vehicles-or of junk or of any waste materials shall be prohibited." - - f. Section 13.303 shall be deleted.in full and the following shall-be adopted: "Sec. 13.303. Vaporizing Liquid_Extin- guishers shall not be installed or used in any location." -2- g. Section_13.310._ _(Dry Standpipes) shall be deleted in-full and the following shall be adopted: "Section 13.310.- Dry Standpipes prohibited. The use or installation of dry-_etandpipes shall be prohibited." h. Section 21.103(a)_ shall be deleted and the following shall be adopted: "Section 21-.103(a). The burning of shavings, - sawdust, and refuse materials,sliall be prohibited." i. Section 27.16-I -_-Bonfires and Outdoor Rubbish Fires shall be deleted in full and the following shall be adopted: "Section 27.101. Bonfires and Outdoor Rubbish Fires Prohibited. No person shall kindle or maintain any bonfire or rubbish fire except in an incinerator approved by the Air Pollution Control District having jurisdiction, and any other such fire shall be pro-- hihited.- Fires built in fireplaces used for non- commercial or recreational purposes, fires necessary- fw agricultural operations and fires used for fire - department training purposes shall be exempt from these regulations- if an-appropriate air pollution permit has been obtained and if such fires aisnot, hazardous in the opinion of the Fire Chief." j. Section 27.102, Kindling of Fire on Land of Others_Re_strioted`shali be 'deleted. Section 7. Effective Date.-.. This Ordinance shall take - effect and be in; force thirty'C30)- days after publication following final passage.
