TITLE: AN ORDINANCE ACCEPTING CONVEYANCE OF PUBLIC PARK LANDS BY
MEANS OF QUIT CLAIM DEED FROM FRUITDALE SANITATION DISTRICT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, that:
WHEREAS, the Fruitdale Sanitation District has tendered
to the City of Wheat Ridge a Quit Claim Deed for certain land
situated in the County of Jefferson and the State of Colorado, said
land being described as follows:
A tract of land in the North quarter of the Northeast
quarter of the Southeast quarter of Section 21, Township 3
South, Range 69 West of the Sixth Principal Meridian, more
particularly described as follows; to-wit:
Beginning on the East-West center line of Section 21,
Township 3 South, Range 69 West at an angle iron that
marks the Northeast corner of the tract described in
Book 151 at Page 22 of the Jefferson County records 464
feet East from the Sixteenth corner common to the North-
east quarter and Southeast quarter of Section 21, Township 3
South, Range 69 West; thence East along said midsection
line 199 feet to an iron pipe; thence South at right angles
210 feet to another such pipe; thence West and parallel
with the aforesaid East-West midsection line 445 feet more
or less to an iron pipe on the Southeasterly line of the
aforesaid property described in Book 151 at Page 22; thence
Northeasterly along said line 322.5 feet more or less to
the angle iron at the point of beginning, contained 1.55
acres more or less, EXCEPT and reserving unto Fruitdale
Sanitation District, its successors and assigns an EASEMENT,
more particularly described as follows, to-wit:
An easement for the maintenance and operation of sewage
facilities within the SEA/4 of Section 21, T 3 5, R 69 W of
the 6th P. M., described as follows: Beginning at a point
on the north line of the SE1/4 of said Section 21 from whence
the northeast corner of the SE1/4 of said Section 21 bears
N89049.01E 682.60 feet; thence 50005.5'W 45.93 feet; thence
S87022.9'W 171.33 feet; thence 56016.11E 157.65 feet; thence
S89047.01W 17.60 feet; thence N6016.11W 177.48 feet; thence
N16009.91W 21.33 feet; thence N49024.01E 20.06 feet to a
point on the north line of the SEY4 of said Section 21 from
whence the northeast corner of the SEI/4 of said Section 21
bears N89049.01E 864.30 feet; thence 511022.51E 39.06 feet;
thence N87022.9`E 159.11 feet; thence NO005.5'E 31.55 feet;
thence N89049.01E 15.00 feet to the point of beginning.
WHEREAS, it is provided in Section 139-88-1, 1963 Colorado
Revised Statutes, as amended, that any City shall have authority to
acquire, establish and maintain land or interest in land within or
without the corporate limits of the City as in the judgment of the
City Council of such City may be necessary, suitable or proper for
park or recreational purposes for the preservation or conservation
of sites, scenes, open space, and vistas of scientific, historical,
aesthetic or other public interest; and it is further provided in

Section 139-88-2, 1963 C. R. S., that land for any of the purposes
aforesaid may be acquired by a City by gift, and that the said
grantor has tendered the above described land to the City of Wheat
Ridge for the purposes aforesaid as a gift, and
WHEREAS, the said land is and will be of inestimable
value to the City and its people for open space, recreational and
park purposes; and
WHEREAS, the City Council of the City of Wheat Ridge
desires to accept said Deed for the purposes indicated therein;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Wheat Ridge, that:
Section 1. The City of Wheat Ridge does hereby gratefully
accept the aforesaid Quit Claim Deed from Fruitdale Sanitation
District dated May 14, A. D., 1974, for the purposes hereby
previously stated, and does hereby express to the Sanitation
District and its Board of Directors its thanks and appreciation
for the conveyance.
Section 2. The said land shall be and is hereby estab-
lished and dedicated as a public park for the use of the public,
for open space, recreational and park purposes.
Section 3. The City Llerk is authorized and directed to
record the aforesaid conveyance to the City of Wheat Ridge with the
Clerk and Recorder of Jefferson County, Colorado, with a certified
copy of this Ordinance attached thereto.
Section 4. Effective Date: This Ordinance shall take
effect and be in force thirty (30) days after publication following
final passage.
