TITLE. An ordinance to zone land which has been annexed
to the City of Wheat Ridge, a Colorado %Iunicipal Corporation,
amending the zoning maps and declaring an emergency.
BE IT OiUAINED by the City Council of the City of Wheat
ridge, Colorado, that:
Section 1. That the City of Wheat Ridge by
Ordinance, has annexed the hereinafter described real pro-
perty into its corporate boundaries.
Beginning at the Northeast corner of Lot 1, Block
1, Applewood Gardens Subdivision, Jefferson County
Colorado; thence N0048.2'W along the easterly line
of Lots 2,3,4,5,0 and 7 of said Block 1, a distance
of 488.43 feet to the northeast corner of said Lot
7; thence continuing N0048.21W a distance of 50 feet
to the northerly line of West 33rd Avenue; thence
S89039'W along the northerly line of West 33rd Avenue
a distance of 92 feet to the southeasterly corner of
the west 30 feet of Lot 5, Block 4 of said Applewood
Gardens Subdivision; thence N0048.2'W along the easterly
line of tree west 30 feet of said Lot 5 a distance of
130 feet to the north line of said Lot 5; thence
S890391W along the northerly line of said Block 4, a
distance of 211.03 feet to a point 1002.43 feet west
of the east line of Lot 15, Roxbury Garde.is, Jefferson
County, Colorado; thence N0031.31W parallel to the
east line of said Lot 15, a distance of 205 feet to
the north line of said Lot 15; thence N89039'E along
the north line of said Lot 15 a distance of 728.38 feet
to a point 334.1 feet west of the northeast corner of
said Lot 15, said point being on the westerly right-of-
way line of Interstate Highway ;tiro. I-70; thence
soutiherly along the westerly right-of-way line of said
Highway for the following four courses: Sb037.5'W a
distance of 119.2 feet; S00301E a distance of 266.70
feet; S890401W a distance of 32.8 feet; thence S60311W
a distance of 547.73 feet to a point 70 feet north of
the south line of the NW1-4 of Section 29, T35, R69W,
thence S00173/41E a distance of 70 feet to the south
line of the :JW'4 of said Section 29; tnence N89043.5'E
along the south line of the NW4 of said Section 29 a
distance of 456.57 feet to the southeast corner of the
SW', of the NW, of said Section 29; thence S003u'E along
the east line of the W'z SW'4 of said Section 29 a dis-
tance of 60 feet; tnence S89043.5'W a distance of 687.84
feet to a point 635 feet east of the west line of the
SW?,, of said Section 29; thence N0039.5'W parallel to
the west line of the SW1-4 of said Section 29 a distance
of 15 feet; thence S89043.5'W parallel to the north line
of the SW'4 of said Section 29 a distance of 240 feet;
thence N0039.5'W a distance of 45 feet to the north line
of the SW14 of said Section 29; thhence N0048.2'W parallel
to tike west line of the NW'-4 of said Section 29 a dis-
tance of 30 feet to the north line of West 32nd Avenue,
as shown on the plat of said Applewood Gardens Sub-
division; thence N89043.5'E along the north line of
West 32nd Avenue a distance of 30 feet to the inter-

section of the south line of said Lot 1 with the
West line of said Lot 1; thence N0048.21W a distance
of 95 feet to the northwest corner of said Lot 1;

a distance of 115 feet to point of beginning.
Section 2. That said annexing ordinance was
introduced, read, adopted and ordered published on first
reading by a vote of 6 to 0 on the 11th day
of April , 1974.
Section 3. That said annexing ordinance was read,
adopted and ordered published on second and final reading
by a vote of 6 to 0 on the 2nd day of May ,
1974.
Section 4. That no ordinance has been adopted or
passed by the City of Wheat Ridge Zoning that land annexed
by Ordinance No. 152 , in accordance with Chapter 31,
Article 8, Section 115, Colorado Revised Statutes, 1973.
Section S. That the Colorado Revised Statutes
of 1973, provide that the area annexed shall be brought
under such zoning ordinance of the annexing municipality
within ninety (90) days from the effective date of the
annexation ordinance.
Section 6. That the following described annexed
real property be zoned: Planned Commercial Development
District.
Beginning at the Northeast corner of Lot 1, Block
1, Applewood Gardens Subdivision, Jefferson County
Colorado; thence N0048.2'W along the easterly line
of Lots 2,3,4,5,6 and 7 of said Block 1, a distance
of 488.43 feet to the northeast corner of said Lot
7; thence continuing N0e48.21W a distance of 50 feet
to the northerly line of West 33rd Avenue; thence
S89o39'W along the northerly line of West 33rd Avenue
a distance of 92 feet to the southeasterly corner of
the west 30 feet of Lot 5, Block 4 of said Applewood
Gardens Subdivision; thence N0048.21W along the easterly
line of the west 30 feet of said Lot 5 a distance of
130 feet to the north line of said Lot 5; thence
S890391W along the northerly line of said Block 4, a

section of the south line of said Lot 1 with the
West line of said Lot 1; thence N0048.21W a distance
of 95 feet to the northwest corner of said Lot 1;
thence N89043.5'E along the north line of said Lot 1
a distance of 115 feet to point of beginning.
Section 7. That development of the above des-
cribed property shall be in conformance with Section 20, of
the City of Wheat Ridge Ordinance Number 98.
Section 8. That the Wheat Ridge Zoning maps
are hereby amended to include within the Planned Commercial
Development District the above described tract of land.
Section 9. If any part or parts of this ordinance
are for any reason held to be invalid or unconstitutional,
such decision shall not affect the validity or constitu-
tionality of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed
this ordinance and each part or parts thereof, irrespective
of the fact that any one part or parts be declared invalid
or unconstitutional.
Section 10. Emergency Clause. The provisions
of this ordinance are necessary to the immediate preservation
of the public peace, health and safety of the citizens of
Wheat Ridge, Colorado, for the following reasons:

(a) That the annexed territory has not been brought
under the zoning ordinances and map of the City of Wheat Ridge,
Colorado.
(b) That the City of Wheat Ridge, Colorado, is a
statutory City governed by the statutes of the State of
Colorado.
(c) That the statutes of the State of Colorado
provide that the annexed territory to any municipaltiy be
brought under such zoning ordinance and map within ninety
(90) days from the date of the annexing ordinance.
(d) 'T'hat such initial zoning on annexed territory
shall be by ordinance.
(e) That this ordinance is necessary for compliance
with the Colorado Revised Statutes of 1973.
Section 9. Effective Date. This ordinance shall
be in force five (5) days after publication following final
passage provided it shall have been passed by an affirmative
vote of three-fourths (3/4) of the members of the City
Council; otherwise said ordinance shall take effect thirty
(30) days after publication following final passage.
