HomeMy WebLinkAboutOrdinance-1975-0174 - Model Traffic CodeNANCE NO. -1 7h PAGE 1 INTRODUCED BY Dnnaldsnn ORDINANCE NO. 17"* Series of 1975 AN ORDINANCE FOR THE REGULATION OF TRAFFIC BY THE CITY OF WHEAT RIDGL, COLORADO, FOR THE PURPOSE OF PROVIDING A SYSTEM OF TRAFFIC; REGULATIONS CONSISTENT WITH STATE LAIv AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGH- OUT THE STATE. AND THE NATION; ADOPTING BY REFERENCE THE 1974 EDITION OF THE "MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES;" REPEALING ALL ORDINANCES IN CONFLICT THERE- WITH; AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Pursuant to Part 4 of Article 12, of Title 31, C.R.S. 197, there is hereby adopted by reference Articles I through XXVI inclusive, of the "Model Traffic Code for Colorado Municipalities," officially approved, adopted, and published in 1974 as such by the State Department of Highways, Denver, Colorado, of which three (3) copies are now filed in the office of the Clerk of the City of Wheat Ridge, Colorado, and may be inspected during regular business hours, the same being adopted as if set out at length. Section 2. The said Code is subject to the following additions or modifications: ARTICLE XI-1 shall be modified by the addition of: XI-1(15) - Within marked fire lanes or otherwise so as to obstruct marked fire lanes. ARTICLE XXVI- Traffic control schedules for designated streets are established in lieu of records described in Section 23-12 as follows: ORDINANCE NO. 174 Paqe 2 ARTICLE XXVI TRAFFIC CONTROL SCHEDULES FOR DESIGNATED. STREETS (IN LIEU OF RECORDS DESCRIBED IN SECTION 23-12) EXPLANATION OF ARTICLE XXVI TRAFFIC CONTROL SCHEDULES FOR DESIGNATED STREETS TRAFFIC CONTROL SCHEDULES SHOWN IN ARTICLE XXVI ARE INTENDED TO DECLARE CERTAIN LOCAL REGULATIONS THAT MUST BE MADE KNOWN BY OFFICIAL TRAFFIC CONTROL DEVICES, IN EFFECT, THESE SCHEDULES SHOW THE DESIGNATED PLACES WHERE RESTRICTIONS AND PROHIBITIONS OF THE TYPE DECLAR- ED HAVE BEEN PROPERLY AUTHORIZED BY THE LOCAL ROAD AUTH- ORITY, IN THE CASE 0r: STREETS WHICH ARE STATE HIGH"lAYS THE SCHEDULES ALSO °ROVIDE THE NECESSARY DOCUMENTATION FOR REGULATIONS THAT ARE MADE SUBJECT TO THE APPROVAL OF THE STATE DIVISION OF HIGHWAYS. OFFICIAL TRAFFIC CONTROL RECORDS CONTAfl ING THE SAME INFORMATION, AS DESCRIBED IN SECTION 3-12, ARE AN ACCEPTABLE SUBSTITUTE FOR THE SCHEDULES, IN THE LARGER CITIES SUCH RECORDS ARE USUALLY MAINTAINED BY THE TRAFFIC ENGINEER OR OTHER TRAFFIC OFFICIAL, REVISED APRIL U, 1975 _RDINANCE NO. 174 PAGE 3 ARTICLE XXVI TRAFFIC CONTROL SCHEDULES FOR DESIGNATED STREETS Schedule I Sec. 26-1. One-Way streets. - In accordance with the provisions of section 8-1, and when official signs are erected giving notice thereof, traffic shall move only in the direction indicated upon the following streets: Alley between W. 32nd Avenue & W. 33rd Avenue & Between Sheridan & Ames 1-way to the south Schedule VI Sec. 26-6. Parking time limited on certain streets. - In accordance with the provisions of section 12- 2, and when official signs are erected giving notice thereof, no person shall park a vehicle for a period of time longer than ( ) hours or minutes - between the hours of ( ) a.m. and ( )p.m. of any day except Sundays and Public Holidays as defined in section 25-5 (c) upon any of the streets or parts of streets as follows: NONE SCHEDULE Y Sec. 26-10. Penalties. The following penalties, herewith set forth in full, shall apply to this ordinance- (a) It- is unlawful for any person to violate any of the provisions stated or adopted in this ordinance. (b) Every person convicted of a violation of any provision stated or adopted in this ordinance shall be punished by a fine riot exceeding three hundred dollars ($300.00) or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Section 4. Application. This ordinance shall apply to every street, alley, sidewalk area, driveway, park, and to every other public way or public parking area, either within or outside the corporate limits of this municipality, the use of which this municipality has jurisdiction and authority to regulate. The provisions of Sections 5-1, 5-2, 15-12, and 23-3 of the Adopted Model Traffic Code respectively concerning reckless driving, careless driving, unauthorized devices, and accident investigation shall apply not only to public places and ways but a1so throughout this municipality. Section S. Validity. If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid. Section 6. Repeal. Existing ordinances or parts of ordinances (i.e. Ordinance No. 109) covering the same matters as embraced in this ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the pro- visions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 7. Interpretation. This ordinance shall be so interpreted and con- strued as to effectuate its general purpose to make uniform the local traffic regulations contained herein. Article and section headings of the ordinance and adopted Model Traffic Code shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or extent of the provisions of any article or section thereof. Section 8. Publication. The City Clerk shall certify to the passage of this ordinance, cause notice of its contents and passage to be published or posted, and make not less than three copies of the adopted Code available for inspection by the public during regular business hours. Section 9. Effective Date. This ordinance shall take effect from and after the 2nd day of August 1975.
