ORDINANCE NO. 183
Series of 1975
AN ORDINANCE SUBMITTING TO THE ELECTORATE A PROPOSAL THAT
THE POSITION OF CITY CLERK BE APPOINTIVE RATHER THAN
ELECTIVE.
WHEREAS, Section 31-4-107 (4)(a), Colorado
Revised Statutes, 1973, as recodified by H.B. 1089 of
1975, effective July 1, 1975, contains provisions per-
mitting the City Council to submit for approval of the
registered electors, at a regular election, a proposal
that the position of City Clerk be made appointive rather
than elective; and
WHEREAS, the City Council wishes to give the
people an opportunity to change the above named position
from elective to appointive, if they so desire.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO, THAT:
Section 1. Pursuant to Section 31,4-107(4)(a)
C.R.S. 1973, as recodified by H.B. 1089 of 1975, there is
hereby submitted to the electors of the City of Wheat
Ridge, at the next regular election, to be held on November
4, 1975, for their approval or rejection, the question of
whether the position of City Clerk shall be appointive
rather than elective, and which question shall be as
follows:
Shall the position of City Clerk for the
City of Wheat Ridge, Colorado be appointive
rather than elective?
The provisions of the Colorado Municipal election code
of 1965, as amended, shall govern the election of the
proposal.
Section 2. If said proposal shall be approved
at the said election, appointments shall be made by City
Council, but only for terms commencing at the conclusion
of the terms of office of those duly elected City Clerk
on November 4, 1975, and subsequent years to wit: On
the first Monday after the first Tuesday in January, 1978,
and subsequent elections.
Section 3. The City Clerk is hereby authorized
and directed to perform all statutory duties required to
place such issue on the ballot for the November 4, 1975
election.
Section 4. Emergency Clause. The provisions
of this ordinance are necessary to the immediate preser-
vation of the public health and safety of the citizens of
Wheat Ridge, and to submit to the electorate the question
authorized by statute: (a) The Colorado State Statutes,
effective July 1, 1975 authorized this question to be
submitted to the electorate of Statutory Cities, (b) That
the City Council of the City of Wheat Ridge must have this
issue in the form to be submitted to the electorate at least
thirty (30) days prior to the date of November 4, 1975.

Section S. Effective Date. This ordinance
shall take effect and e in force five (5) days after
publication following final passage, providing it shall
have been passed by affirmative vote of three-fourths
of the City Council; otherwise said Ordinance shall take
effect thirty (30) days afterpublication, following
final passage after public hearing.
