HomeMy WebLinkAboutOrdinance-1977-0235 - Amend WR Ord 209 - Penal Code - Trash and Debris on PropertyINTRODUCED BY COUNCILPERSON MERKL ORDINANCE NO. 235 SERIES OF 1977 TITLE: AN ORDINANCE TO AMEND THE WHEAT RIDGE PENAL CODE, ORDINANCE NO. 209, SERIES OF 1975, BY PROVIDING FOR ABATEMENT PROCEDURES FOR JUNK AND TRASH ON PARCELS OF LAND WITHIN THE CITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Chapter 9.30 of Ordinance No. 209, Series of 1975, is hereby amended by adding the following sections: 9.30.041 Abatement Procedures. In the event that any person fails to keep or store any trash, garbage, refuse, debris or waste of any nature in accordance with this Ordinance, the Code Enforcement Officer shall, following written notification to such offender, direct that the trash, garbage, refuse, debris or waste be cleaned up and removed by the City and charge such cost thereof to the person in violation, with a five percent (5°0) additional cost for inspection and other incidentals. 9.30.042 Collection of Costs. (a) In the event that any trash, garbage, refuse, debris or waste of any nature is cleaned up or removed by the City pursuant to 9.30.041 of this Code, then the whole cost of such removal, together with a five percent (5%) additional cost for inspection and other incidentals, shall be paid by the person in violation of this chapter. Said costs shall be paid to the City Treasurer within thirty (30) days after the City Treasurer has mailed notice of the assessment of such cost, by registered or certified mail, to the person permitting the illegal keeping or storage of said trash, garbage, refuse, debris or waste. (b) Failure to pay such assessment within such thirty (30) days shall cause such assessment to ORDINANCE 235 become a lien against such lot, block or parcel of land upon which such trash, garbage, refuse, debris or waste was improperly stored. Said lien shall have priority over all liens, except general taxes and prior special assessments. In the event that said costs are not paid within thirty (30) days, as specified in this Ordinance, at any time after the expiration of thirty (30) days from the date of mailing by the City Treasurer, the Mayor or his designated representative may certify said lien to the County Treasurer to be placed upon the tax list for the current year, and to be collected in the same manner as other taxes are collected, with ten percent (100/0) penalty to defray the cost of collection. 9.30.043 Method of Notification. (a) The Code Enforcement Officer or other designated agent of the City of Wheat Ridge shall post properties in violation of this Ordinance. Such posting of notice shall be dated and signed by the Code Enforce- ment Officer or designated agent of the City and shall include a statement directing that failure to clean up and remove the trash, garbage, refuse, debris or waste in violation of this Ordinance within 48 hours of the posting of this Ordinance will result in the Code Enforcement Officer directing that such trash, garbage, refuse, debris or waste be cleaned up by the City and the cost thereof plus five percent (5%) be charged to the person in violation. Section 2. This Ordinance shall take effect thirty (30) days after final publication, and shall apply to all offenses occurring on or after said date. All offenses committed and all liabilities incurred prior to the effective date of this Ordinance shall be treated as though all prior applicable Ordinances and amendments thereto were in full force and effect - 2 - ORDINANCE 235 for the purpose of sustaining any proper suit, action or prosecution with respect to such offenses and liabilities.
