ORDINANCE NO. 287
Series of 1978
TITLE: AN ORDINANCE ADOPTING BY REFERENCE "THE COLORADO
MODEL ENERGY EFFICIENCY CONSTRUCTION AND RENOVATION
STANDARDS FOR NONRESIDENTIAL BUILDINGS OF THE STATE
OF COLORADO"; AND PROVIDING A PENALTY FOR VIOLATION
THEREOF.
WHEREAS, Sentate Bill No. 432, adopted by the Colorado General
Assembly in 1977, requires each municipality which has a
building code to adopt energy efficiency construction and
renovation standards for nonresidential buildings prior to
July 1, 1978; and
WHEREAS, the City of Wheat Ridge, Colorado has a building
code;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE:
Section 1. Adoption:
Pursuant to tile 31, article 16, part 2, Colorado Revised
Statutes 1973 as amended, there is hereby adopted as the
energy efficiency construction and renovation standards for
nonresidential buildings of the City of Wheat Ridge, Colorado,
adopted November 1977, and published March, 1978, by the
State of Colorado, Office of State Planning and Budgeting
Board for Energy Efficient Nonresidential Building Standards,
1525 Sherman Street, Denver, Colorado 80203, of which three
(3) copies are to be filed in the office of the City Clerk of
the City of Wheat Ridge, Colorado, and may be inspected during
regular business house. The subject matter of the adopted
standards include comprehensive provisions and standards
regulating energy efficiency in the design, construction,
renovation, erection, enlargement, alteration, repair,
conversion, occupancy, equipment and maintenance of certain
nonresidential buildings and structures, which results in,
or is likely to result in, a fifty percent or greater increase
in the value of the building, for the purpose of protecting
the public health, safety and general welfare. "The Colorado
Model Energy Efficiency Construction and Renovation Standards
for Nonresidential Buildings" is adopted as if set out at length.
Section 2. Amendments:
"The Colorado Model Energy Efficiency Construction and Renovation
Standards for Nonresidential Buildings" is hereby amended as
follows:
(a) Section 101.1 is deleted in its entirety.
(b) Section 107.0 is deleted in its entirety.
(c) A new Section 108.0 is added, to read:
108.0 Administrative and Appeal Procedures.
"Administrative and appeal procedures set forth in
Sections 201, 202, and 204 of the Uniform Building
Code and Chapter Three of the Uniform Building Code,
1973 adopted by the City of Wheat Ridge, shall be
applicable and followed in the administration of
this Code.
(d) Section 302.1 is amended by the inclusion of the

(f) Section 701.0 is amended by the addition of the following:
SMACNA refers to Sheet Metal Air Conditioning Contractors
National Association. NESCA refers to National Environ-
mental System Contractors Association. NWMA refers to
National Woodwork Manufacturing Association, Inc.
Section 3. Code Copies.
At least three copies of the Colorado Model Energy Efficiency
Construction and Renovation Standards for Nonresidential Buildings,
certified by the Mayor and the City Clerk to be true copies, have
been and will continue to be on file in the office of the City
Clerk, and may be inspected by any interested person between the
hours of 8:30 A.M. and 5:00 P.M., Monday through Friday, holidays
excepted.
The Colorado Model Energy Efficiency Construction and Renovation
Standards for Nonresidential Buildings will be available for
purchase by the public at a moderate price.
Section 4. Penalties.
It shall be unlawful for any person, firm, or corporation to
erect, construct, renovate, enlarge, alter, repair, improve,
convert, equip, use, occupy, or maintain any building or structure
in the City, or cause or permit the same to be done, contrary to
or in violation of any of the provisions of the Colorado Model
Energy Efficiency Construction and Renovation Standards for
Nonresidential Buildings.
Any person, firm, or corporation violating any of the provisions
of the Colorado Model Energy Efficiency Construction and Renovations
Standards for Nonresidential Buildings or of this ordinance shall be
punishable by a fine not exceeding three hundred dollars ($300) or
imprisonment not exceeding ninety (90) days or by both such fine
and imprisonment. Each and every day or portion thereof during
which any such violation is committed, continued, or permitted,
shall be considered a separate offense.

Section 5. Buildinq Permits.
No building permit shall be issued for the construction, renovation,
erection, enlargement, alteration, repair or maintenance of any
nonresidential building unless such shall conform to the provisions
stated or adopted in this ordinance.
Section 6. Severability Clause.
If any part, section, subsection, sentence, clause, or phrase
of this ordinance or of the Colorado Model Energy Efficiency
Construction and Renovation Standards for Nonresidential Buildings
adopted hereby is for any reason held to be invalid, such inval-
ibility shall not affect the validity of the remaining sections
of the ordinance or of the standards; the City Council hereby
declares that it would have passed the ordinance and adopted such
standards in each part, section, subsection, sentence, clause,
or phrase thereof, irrespective of the fact that one or more parts,
sections, subsections, sentences, clauses, or phrases be declared
invalid.
Section 7. Certification and Publication.
The City Clerk shall cause to be published in a newspaper of
general circulation in the City of Wheat Ridge, Colorado, the
following notice:
Notice is hereby given of public meeting before the City
Council of Wheat Ridge, Colorado, at 7:30 p m. of the
17th day of July , 1978, at the City Hall, 7500 W.
29th Ave. , Wheat Ridge, Colorado, for the purpose
of considering the adoption by reference of "The Colorado
Model Energy Efficiency Construction and Renovation Standards
for Nonresidential Buildings of the State of Colorado" as the
standards for energy efficiency construction in the City of
Wheat Ridge, Colorado.
Certified copies of the Model Code are on file at the
office of the City Clerk and may be inspected during
regular business hours. If enacted as an ordinance of
the City, the Model Code will not be published in full,
but in accordance with State law, copies will be kept on
file and also made available for distribution and sale to
the public.
"The Colorado Model Energy Efficiency Construction and
Renovation Standards for Nonresidential Buildings of the
State of Colorado" is published by the State of Colorado,
office of State Planning and Budgeting Board for Energy
Efficient Nonresidential Building Standards, 1525 Sherman
Street, Denver, Colorado 80203. The subject matter of the
adopted energy standards include comprehensive provisions

Such notice shall be published once at least 15 days preceding
the scheduled public hearing, and once again at least 8 days
preceding said public hearing. The City Clerk shall cause to
be published in a newspaper of general circulation in the City
of Wheat Ridge, the full text of this ordinance once at least 7
days prior to adoption and once following final passage. The
City Clerk shall certify to the passage of this ordinance and
make not less than 3 certified copies of the adopted Code available
for inspection by the public during regular business hours at the
office of the City Clerk.
Section 8. Effective Date.
This ordinance shall take effect one (1) day after final
publication.
