ORDINANCE NO. 315
Series of 1979
TITLE: AN ORDINANCE AMENDING SECTION 4-1 AND SECTION 4-6
OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 4-1 of the code of the City of Wheat Ri:'xn_e,
Colorado, is hereby amended to read as follows:
Sec. 4-1. Definitions.
For the purposes of this chapter the following words and
phrases shall have the meanings respectively ascribed to
them by this section:
(a) Abandonment. Includes the leaving of an animal by
its owner or owners or other person or persons
responsible for its care or custody without making
effective provisions for its proper care.
(b) ___tmal. Any living dumb creature.
(c) ani__ial shelter. Any premises designated by the
C4 - for the purpose of boarding and caring for
and animal impounded under the provisions of this
chapter or any other ordinance or law of the
state.
(d) Animal warden. Any person or persons empowered by
the City to enforce the provisions of this chapter.
(e) Dogs. Any animal of the canine species regardless
of sex.
(f) Dog owner. Any person owning, keeping or harboring
a dog or dogs.
(9) Guard dog. A dog trained to protect persons or
property by attacking or threatening to attack any
person found within the area patrolled by the dog.
These dogs must be registered with the City as
guard dogs.
(h) Mistreatment. Every act or omission which causes,
or unreasonably permits the continuation of unnecessary
or unjustifiable pain or suffering.
(i) Neglect. Failure to provide food, water, protection
from the elements, opportunity for exercise, or
other care normal, usual and proper for an animal's
health and well-being.

(j) Running at large. Off the premises of the owner
and not under effective control of such owner, his
agent, servant or a competent member of his family
by means of a leash, cord or chain.
(k) Vicious dog. A dog that unprovokedly bites or
attacks humans or other animals, or in a vicious
or terrorizing manner approaches any person in an
apparent attitude of attack.
Section 2. Section 4-6 of the Code of the City of Wheat Ridge,
Colorado, is hereby amended to read as follows:
Sec. 4-6. Cruelty or inhumane treatment.
It shall be unlawful for any person to commit or cause to
be committed any act of cruelty, harassment, abandonment,
torture, mistreatment or neglect, or cause such animal to
be wounded, mutilated, strangulated or inhumanely killed.
Ownership of such animal shall not be a justifiable
defense for such acts or for a violation of this section.
Section 3. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any
person or circumstances shall for any reason be adjudged by
a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect fifteen (15) days
after final publication.

6 to 0 on this 8th day of January , 1979;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for January 22 , 1979, at
7:30 o'clock p.m., at Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 6 to 0 , this 31st day of
January , 1979.
