HomeMy WebLinkAboutOrdinance-1979-0320INTRODUCED BY COUNCiLMEMBER Donaldson ORDINANCE NO. 320 Series of 1979 TITLE AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM AGRICULTURE- ONE (A-1) AND AGRICULTURE-TWO (A-2) TO INDUSTRIAL (I) AND AN OUTLINE DEVELOPMENT PLAN FOR LAND LOCATED AT APPROXIMATELY THE NORTHWEST CORNER OF I-70 AND TABOR STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE COLORADO, THAT- Section 1. Upon application of W. E. Allen and Bob Vermillion, Brown Energy Development, for approval of rezoning and an Outline Development Plan in Wheat Ridge Case No. WZ-78-118, and upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based upon testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge Zoning Maps are hereby amended to exclude from the Agriculture-One (A-1) and Agriculture-Two (A-2) Zone Districts and to include within the Industrial (I) Zone District the following described land That part of Lots 4, 5, and 6, LEE'S SUBDIVISION, County of Jefferson, State of Colorado described as follows: Beginning at the Southeast corner of the SE1/4 of Section 17, Township 3 South, Range 69 West of the 6th P.M.; thence ;S89028100"W (based upon Colorado Highway Department bearings) along the South line of Said SE1/4 a distance of 1323.45 feet to the West line of LEE'S SUBDIVISION, County of .Jefferson, State of Colorado, thence N000511111W along said West line a distance of 330.10 feet to the Northwest corner of Lot 4 of said LEE'S SUBDIVISION, which corner is also the TRUE POINT OF BEGINNING; thence S000S'll"E along the West line of said Lot 4 a distance of 330.10 feet to the Northwest corner of Lot 5, which is the Northwest corner of the NE1/4, NE1/4, of Section 20, Township 3 South, Range 69 West of the 6th Principal Meridian, of said LEE'S SUBDIVISION, which corner is on the North line of the NE1/4 of Section 20, Township 3 South, Range 69 West of the 6th Principal Meridian; thence S0009115"E along the West line of Lot 5 and 6 of said LEE'S SUBDIVISION a distance of 643.31 feet to the North line of the Colorado State Highway Department right-of-way described under receiption number 213296 of the Jefferson County Records; thence N649171S711E along said North right-of-way line a distance of 619.00 feet, thence N001414811W along the West right-of-way line of said Colorado State Highway Department right-of-way a distance of 538.47 feet, thence N1205813811E continuing along said West right-of-way line a distance of 176.46 feet to the North line of said Lot 4; thence S8902614011W along said North line a distance of 598.04 feet to the TRUE POINT OF BEGINNING, containing 10.874 acres more or less In addition, the Brown Energy Outline Development Plan is hereby approved subject to the following stipulations being placed on the plan document: (1) Building height will not exceed 50 feet and will in no instance exceed a top elevation of 5467 feet (MSL) anywhere on the site so as to minimize the visual impact for those residences to the East across Tabor Street, and (2) Uses allowed shall be general. office and restaurant. Section 2. This ordinance shall take effect 15 days after final publication.
