HomeMy WebLinkAboutOrdinance-1980-0376INTRODUCED BY COUNCILMEMBER Ore ORDINANCE NO. 376 Series of 1979 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 21-21 AND SECTION 21-23 OF CHAPTER 21, ARTICLE II OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, PERTAINING TO TAXATION OF TELEPHONE EXCHANGES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 21-21 of Chapter 21, Article II of the Code of the City of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: Sec. 21-21. Levied. There is hereby levied against every telephone utility which is engaged in the business of furnishing local exchange of telephone service within the city a tax on the privilege of engaging in such business. The amount of such tax shall be $92,997.00. Section 2. Section 21-23 of Chapter 21, Article II of the Code of the City of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: Sec. 21-23. Payment. The tax levied by this article shall be retroactive to the first day of January, 1980. The tax shall be payable in twelve (12) equal monthly installments, each installment to be paid on the last business day of each calendar month. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect January 1, 1980.
