HomeMy WebLinkAboutOrdinance-1980-0388INTRODUCED BY COUNCILMEMBER BOWMAN ORDINANCE NO. 388 Series of 1980 TITLE: AN ORDINANCE AMENDING ORDINANCE NO. 368 BY ADDING SECTION 1, 6, b AND C; AND SECTION 2, 6, c TO APPENDIX A OF THE ZONING ORDINANCE OF THE CODE OF LAWS, CITY OF WHEAT RIDGE, WHICH SECTIONS PERTAIN TO FENCES, WALLS, LIGHTING STRUCTURES AND OBSTRUCTIONS TO VIEW. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section Eleven: RESIDENTIAL-THREE A DISTRICT (F) Appendix A, Zoning Ordinance, is amended by the addition of subsection b and c to read as follows: 6. Recreational Fences and Lighting: b. Lighting structures for recreational uses shall not exceed the maximum height for structure in this district. C. Where it is desired to exceed the standards as determined in a or b above, approval must be by Special Use Permit from the Planning Commission and City Council after proper notification by the posting of a sign on the subject property not less than 15 days prior to the date of public hearing. Section 2. Section Sixteen: RESTRICTED COMMERCIAL ONE DISTRICT (F) Appendix A, Zoning Ordinance, is amended by the addition of sub- section c to read as follows: 6. Recreational Fences and Lighting: C. Section 3. Safety Clause. The City Council hereby finds, deteri:lines and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circum- stances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect _ 30 days after final publication.
