HomeMy WebLinkAboutOrdinance-1980-0397INTRODUCED BY COUNCILMErTER MERKL ORDINANCE NO. 397 Series of 1980 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 5-37 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, COLORADO, ADOPTING BY REFERENCE THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS DWELLINGS, 1979 EDITION, COPYRIGHT 1979, AND PROVIDING PENALTIES FOR VIOLATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: Section 1. Section 5-37 of the Code of Laws of the City of Wheat Ridge, Colorado, is hereby repealed and reenacted as follows: "The Uniform Code for the Abatement of Dangerous Buildings 1979 Edition, copyright 1979, by the International Conference of Building Officials, is hereby adopted by reference and incorporated into this article as though fully set forth herein as the Code of the City of Wheat Ridge for the Abate- ment of Dangerous Buildings. Three (3) copies of said Uniform Code for the Abatement of Dangerous Buildings shall be filed in the office of the City Clerk and may be inspected during regular business hours. Such Code is hereby adopted in full. Section 2. Purpose. The purpose of this Code is to provide a just, equitable and practicable method to be cumulative with and in addition to any other remedies provided by the Uniform Building Code, 1979 Edition, or otherwise available at law, whereby buildings or structures which, for any reason, endanger the life, limb, health, morals, property, safety, or general welfare of the public or the occupants of said structures, may be required to be repaired, vacated or demolished. Section 3. Violation and Penalties. It shall be unlawful for any person, firm or corporation to wreck, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the City, or cause or permit the same to be done, contrary to, or in violation of any of the provisions of the Uniform Building Code. Section 4. Severabili~y. If any part or parts of this ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid. Section 5. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 6. This ordinance shall take effect 14 days after final publication.
