HomeMy WebLinkAboutOrdinance-1980-0423INTRODUCED BY COUNCILMEMBER BOWMAN ORDINANCE NO. 423 Series of 1980 TITLE: AN ORDINANCE PROVIDING FOR THE REZONING OF LAND FROD^_ RESTRICTED COMMERCIAL (R-C) TO COMMERCIAL ONE (C-1) ON PROPERTY LOCATED AT APPROXIMATELY 4900 KIPLING STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of D. W. Roth of Silco Oil Company for approval of rezoning in Wheat Ridge Case No. tiVZ-80-24 and upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based upon testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge Maps are hereby amended to exclude from the Restricted Commercial (R-C) and to include in the Commercial One (C-1) zone district for the following described land: That part of the NW 1/4 of the SW 1/4 of the SW 1/4 of Section 15, Township 3 South, Range 69 West of the 6th P.M. described as follows: Beginning at a point 25.00 feet North and 55.00 feet East of the Southwest corner of said NW 1/4 of the SW 1/4 of the SW 1/4; thence Northerly and parallel to the West line of said NW 1/4 of the SW 1/4 the SW 1/4 a distance of 172.00 feet; thence Easterly and parallel to the South line of said NW 1/4 of the SW 1/4 of the SW 1/4, a distance of 126.50 feet; thence Southerly and parallel to the West line of said NW 1/4 of the SW 1/4 of the SW 1/4 a distance of 15.00 feet; thence Easterly and parallel to the South line of said NW 1/4 of the SW 1/4 of the SW 1/4 a distance of 23.50 feet; thence Southerly and parallel to the West line of said NW 1/4 of the SW 1/4 of the SW 1/4 a distance of 157.00 feet; thence Westerly and parallel to the South line of said NW 1/4 of the SW 1/4 of the SW 1/4 a distance of 150.00 feet to the point of beginning. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, imoair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on this 15th day of September , 1980; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for October 13 , 1980, at 7:30 o'clock p.m., at Council Chamber, 7500 ?nest 29th Avenue, Wheat Ridge, Colorado.
