HomeMy WebLinkAboutOrdinance-1980-0428ORDINANCE NO. 428 INTRODUCED BY COUNCILMEMBER ORE Series of 1980 TITLE: AN ORDINANCE AMENDING SECTIONS 4, 5, 6, 7, 8, 9, 10, 11, 14, AND 15 OF APPENDIX A, ZONING ORDINANCE OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, WHICH AMENDMENT RELATES TO GROUP HOMES FOR THE DEVELOPMENTALLY DISABLED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Appendix A, Zoning Ordinance, of the City of Wheat Ridge, Colorado, Subsection A of Sections 4, 5, 6, 7, 8, 9, 10, 11, 14, and 15 are hereby amended by the addition of the following permitted use to read as follows: Group Home for the Developmentally Disabled. This is a residential facility, licensed by the State for the purpose of providing twenty-four hour staff care, shelter, super- vision, training and/or rehabilitation to no more than eight (8) developmentally disabled persons and additional required staff. As defined in CRS 31-23-304, "Develop- mentally Disabled" means those persons having cerebral palsy, multiple sclerosis, mental retardation, autism, and epilepsy. A Group Home for the Developmentally Disabled shall not be architecturally designed so as to be inconsistent with the character of the surrounding neighborhood. For every Group Home for the Developmentally Disabled, all requirements for a single family home shall be met and also must meet the requirement that the lot area shall be a minimum of 1500 square feet for each bed contained within the horse. No Group Home for the Developmentally Disabled shall be located closer than 750 feet from another Group Home for the Developmentally Disabled. Section 2. Safety Clause. The City Council hereby finds, deter- mines and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 1 days after final publication. INTRODUCED, READ AND ADOPTED on first reading by a vote of 7 to 0 on this 3rd day of November , 1980, ordered published in full in a newspaper of good circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for November 24 , 1980, at 7:30 o'clock p.m., at Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
