SERIES OF 1980
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A ZONING MAP
CORRECTION FOR PARCEL A FROM COMMERCIAL ONE (C-1) TO
RESTRICTED COMMERCIAL (R-C) FOR LAND LOCATED AT APPROXI-
MATELY 11880 W. 44th AVE., AND A ZONING MAP CORRECTION
FOR PARCEL B FROM COMMERCIAL ONE (C-1) TO AGRICULTURE ONE
(A-1) FOR LAND LOCATED AT APPROXIMATELY 12020 W. 44th
AVE., AND A ZONING MAP CORRECTION FOR PARCEL C FROM COM-
MERCIAL ONE (C-1) TO AGRICULTURE TWO (A-2) FOR LAND
LOCATED AT APPROXIMATELY 12040 W. 44th Avenue.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application of the City of Wheat Ridge for approval
of a zoning map correction in Wheat Ridge, Colorado, Case No. WZ-78-40D
and based upon recommendation for approval from the Wheat Ridge Planning
Commission and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council, Wheat
Ridge maps are hereby corrected to exclude from the Commercial One
(C-1) District and to include in the Restricted Commercial (R-C)
District the following described land:
Parcel A: The West 20 feet of the North 125 feet of the East
1/2 of Lot 11, Lee's Subdivision, Jefferson County,
Colorado.
Also to exclude from the Commercial One (C-1)District and to include
in the Agriculture One (A-1) District the following described land:
Parcel B: The South 85 feet of the North 385 feet of the ?nest
330 feet of Lot 11, Lee's Subdivision, Jefferson
County, Colorado.
Also to exclude from the Commercial One (C-1) District and to include
in the Agriculture Two (A-2) District the following described land:
Parcel C: That part of Tract 6, Pearl of The Valley Subdivision,
lying North of a line 385 feet South of the South line
of 44th Avenue (extended westerly) as platted in Lee's
Subdivision, except the North 300 feet thereof,
Jefferson County, Colorado.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general police
power of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is necessary
for the preservation of health and safety and for the protection of
public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to the proper legislative
object to be attained.
Section 3. Severabilitv. If anv clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or circum-
stances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or in-
validate the remainder of this ordinance or its application to other
persons or circumstances.

Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to
0 on this 8th day of December 1980; ordered published
in full in a newspaper of general circulation in the City of Wheat
Ridge and Public Hearing and consideration on final passage set for
Monday, Januarv 12 , 1981, at 7:30 o'clock p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.

vote of 7 to 0 this 12thdav of January 1981!-
