HomeMy WebLinkAboutOrdinance-1981-0439INTRODUCED BY COUNCILMEMBER ORE ORDINANCE NO. 439 Series of 1980 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-TWO (R-2) TO RESTRICTED COMMERCIAL ONE (RC-1) WITH CONDITIONS FOR LAND LOCATED AT APPROXIMATELY 12600 WEST 32ND AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of Willard Hardesty and Thomas E i-TT'bt~ for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-80-32, and based upon recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the Residential- Two District and to include in the Restricted Commercial One District the following described land: Lot 1, Block 2, Maple Grove Village. Section 2. Conditions. The permitted uses within this zone district for the parcel described above shall be all uses within the Restricted Commercial One District except: 2. Veterinary hospitals (small animals). 3. Service establishments employing not more than three (3) persons as listed below: a. Barber shops. b. Watch and jewelry repair. C. New and/or confectionary stands. d. Beauty shops. e. Pharmacies. f. Pick-up stations for laundry or dry-cleaning. g. Other similar uses. 4. Post office and banks, loan and finance companies. 5. Public, parochial and private schools (including private, vocational trade or professional schools), colleges, universities, preschools and day nurseries (including those uses commonly accepted as necessary thereto when located on the same premises.) 6. Community buildings, Y.M.C.A's, churches, libraries, parks, museums, aquariums and art galleries. 7. Golf courses (but not including miniature golf or putting ranges, driving ranges, private clubs or restaurants) and those uses commonly accepted as accessory thereto when located on the same premises. 8. Mortuaries. 9. Parking of automobiles of clients, patients, patrons or customers of the occupants of adjacent commercial districts. 143c 10. Restaurants (excluding drive-in restaurants) when contained within professional building. 12. Homes for the aged, nursing homes (but not including facilities for mentally disturbed or defectives or for care and treatment of animals). 13. Greenhouses, provided that sale at wholesale be limited to those products produced on the premises. Retail sales shall not be permitted from greenhouses in any residential district. 14. Other similar uses. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulagated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 1 day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 1 on this 15th day of December , 1980; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for January 19 , 1981, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
