ORDINANCE NO. 448

TITLE. AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL
THREE (R-3) AND COMMERCIAL-ONE (C-1) TO PLANNED COMMERCIAL DEVELOPMENT
(PCD) AND APPROVAL OF AN OUTLINE DEVELOPMENT PLAN ON LAND LOCATED AT
4020 AND 4084 WADSWORTH BOULEVARD, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT
Section 1. Upon application of Randoll;h G. Currier, Et Al for approval of rezoning
and an Outline Development Plan in Wheat Ridge, Colorado, Case No. WZ-80-2 and
based upon recommendation for approval from the Wheat Ridge Planning Commission
and pursuant to findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended
to exclude from the Residential-Three and Commercial-One and to include in the
Planned Commercial Development District, and also does approve an Outline
Development Plan on the following described land:
That part of the NW 1/4 of SE 1/4 of Section 23, Township 3 South,
Range 69 West of the 6th P.M., described as follows: Beginning at a
point on the East Right of Way line of Wadsworth Boulevard which is
1,053.436 feet North and 45 feet East of the South Quarter Corner of
said Section; thence North along the East Right of Way line of Wadsworth
Boulevard a distance of 136.404 feet; thence North890 58106"East 612.816 feet
to the East line of said NW 1/4 of SW 1/4 of SE 1/4; thence South along
said East line a distance of 136.379 feet; thence South 890 57'59"West
612.872 feet to the point of beginning; and That part of the NW 1/4, of
the SW 1/4, of the SE 1/4 of Section 23, T3S, R69W, of the 6th P.M.,
County of Jefferson, State of Colorado, being more particularly described
as follows: Beginning at the NW corner of the NW 1/4 of the SW 1/4, of
the SE 1/4 of said Section 23, thence N890 58'13.7"E and along the North
line of the NW 1/4, of the SW 1/4, of said Section 23, 195.00 feet to the
True Point of Beginning; thence continuing along said before described
line, 462.761 feet, and to the East line of the NW 1/4 of the SW 1/4 of
the SE 1/4 of said Section 23, thence SO°05'34.3"W and along the East
line of the NW 1/4, of the SW 1/4, of the SE 1/4 of said Section 23,
132.410 feet; thence S890 58106"W, 462.816 feet; thence NO°07'00"E,
132.426 feet; to the True Point of Beginning. Said parcel containing
1.4067 acres, more or less. Together with: A non-exclusive easement for
ingress and egress over the South 15 feet of the East 150 feet of the
West 195 feet of the above described property. Together with: A perpetual
non-exclusive driveway easement for ingress and egress over and across the
following described property; to wit: A strip of land over part of
former Lot 1, PARKVIEW NO. 1, now known as Lot 1, PARKVIEW NO. 2 described
as follows: Beginning at a point on the South line of said Lot 1, which
point is 302.85 feet Easterly of the Southwest corner of said Lot 1,
thence Easterly along the South line of said Lot 1 a distance of 56.57 feet;
thence on an angle to the left of 135 degrees 00100" a distance of 69.30 feet;
thence on an angle of 45 degrees to the left a distance of 278.67 feet;
thence on an angle of 44 degrees 11'35" to the right a distance of 44.28 feet,
to a point on the West line of said Lot 1 which point is 79.87 feet North
of the Southwest corner of said Lot 1, thence South along the West line
of said Lot 1, a distance of 34.87 feet; thence on an angle to the left
of 45 degrees 48125" a distance of 30.13 feet; thence on an angle to the
left of 44 degress 11'35" a distance of 257.25 feet; thence on an angle
to the right of 45 degrees 0010011, a distance of 33.94 feet to the Point
of Beginning. Together with a perpetual nonexclusive driveway easement
for ingress and egress over and across the following described property.
Commencing at the Northwest corner of the Northwest 1/2 of the Southwest 1/4
Southeast 1/4 of Section 23, Township 3 South, Range 69 West, thence Easterly
along the North line of said Northwest 1/4 Southwest. 1/4 of Southeast 1/4
Section 23, a distance of 302.85 feet to the True Point of Beginning; thence
continuing Easterly along said North line a distance of 196.51 feet; thence
on a deflection angle of 135°00'00" to the right a distance of 43.7 feet;
thence on a deflection angle of 45°00'00" to the right a distance of
135.71 feet; thence on a deflection angle of 45°00'00" to the right a
distance of 43.7 feet to the True Point of Beginning.

Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the preservation
of health and safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a rational relation
to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment
shall not affect, impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 9th day of March , 1981; ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for Anril 13 , 1981, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th, Avenue; Wheat
Ridge, Colorado.
