ORDINANCE NO. 452

TITLE, AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-
TWO (R-2) TO PLANNED RESIDENTIAL DEVELOPMENT (PRD), APPROVAL OF A
PRELIMINARY DEVELOPMENT PLAN, AND PLAT FOR LAND LOCATED AT APPROXI-
MATELY 4200 OWENS STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Golden Eagle Builders, Inc., for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-80-33 and based upon recom-
mendation for approval from the Wheat Ridge Planning Commission and pursuant
to findings made based on testimony and evidence presented at public hearing
before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to
exclude from the Residential Two District and to include in the Planned Resi-
dential District and approval of a Preliminary Development Plan and Plat on the
following described land:
A parcel of land being Lots 4, 5 and 6, Block 1, and Lots 4, 5 and 6,
Block 2, Owens Park Subdivision in the West 1/2 of Section 21, T3S,
R69W of the 6th P.M., City of Wheat Ridge, as recorded in Book 36 at
Page 55 of the records of the County of Jefferson,State of Colorado,
more particularly described as follows: Beginning at the center corner
of said Section 21, also being a point on the East line of Block 1;
thence South 187.46 feet along said East line of Block 1 to the Southeast
corner of said Owens Park Subdivision; thence West 264.00 feet along the
South line of said Owens Park Subdivision to the Southwest corner of
said Owens Park Subdivision; thence North 375.70 feet along the West line
of said Block 2 to the Southwest corner of Lot 3 of said Block 2, thence
East 264.00 feet along the South line of said Lot 3, Block 2 and its
Easterly extension thereof to the Southeast corner of Lot 3 of said
Block 1; thence South 188.24 feet along said East line of Block 1 to
the Point of Beginning containing 2.277 acres more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the preservation
of health and safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a rational relation
to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 23rd day of March , 1981; ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for April 27 , 1981,
at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue; Wheat Ridge,
Colorado.
