HomeMy WebLinkAboutOrdinance-1981-0462INTRODUCED BY COUNCILMEMBER TURNER ORDINANCE NO. 462 Series of 1981 TITLE: AN ORDINANCE AMENDING SECTION 27 OF APPENDIX A, REGULATIONS APPLICABLE TO ALL DISTRICTS; SECTION 28 of APPENDIX A, DEFINITIONS; AND SECTION 25 OF APPENDIX A - NONCONFORMING LOTS, USES AND STRUCTURES, OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, WHICH RELATES TO THE FENCING OF SWIMMING POOLS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section 27 of Appendix A, Regulations Applicable to all Districts is hereby amended to include the following: G. Every swimming pool which is constructed within the City of Wheat Ridge shall be enclosed by a six foot fence with all gates being self-locking and closed and kept locked when the pool is not in use. In situations where the six foot fence requirement exceeds other fence height requirements, the higher requirement shall take precedence. Section 2. Section 28 of Appendix A, Definitions is hereby amended to include the following: 53. Swimming Pool. A tank of water either above or below grade level in which the depth of water exceeds two feet in depth and which the express purpose of the tank is for swimming. Swimming pools shall not include wading pools under two foot in depth, fish ponds, hot tubs, or other similar items. Section 3. Section 25 of Appendix A, Nonconforming Lots, Uses and Structures is hereby amended to include the following: L. Swimming Pools. 1. The lawful use of a swimming pool existing at the effective date of Ordinance No. 462, may be continued although such use does not conform to the provisions of the fencing requirements of Section 27 G, of the Wheat Ridge Code of Laws, provided that 1.8 months after the effective date of Ordinance No. 462, that all non- conforming pools shall conform to Section 27 G. 2. In the event that a nonconforming swimming pool is enlarged, reconstructed, or replaced, the swimming pool must conform to Section 27 G of the Zoning Ordinance. Section 4. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. Severability. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 6.
