HomeMy WebLinkAboutOrdinance-1981-0479INTRODUCED BY COUNCILMEMBER Merkl ORDINANCE NO. 479 Series of 19$1 TITLE- AN ORDINANCE AMENDING CHAPTER 2, ARTICLE IV, SECTION 2-24,CODE OF THE CITY OF WHEAT RIDGE, COLORADO, WHICH PERTAINS TO DUTIES AND RESPONSIBILITIES OF THE PLANNING COMMISSION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Chapter 2, Article IV, Section 2-24, Code of Laws of tthie -City of Wheat Ridge shall be amended by the addition of the following: (h) Minor subdivision plats without public street dedications or public reservations shall be heard and approved by the Planning Commission at a public hearing. Public hearings shall be conducted following procedures outlined in the subdivision regulations. (i) Minor subdivision plats with public street dedications or public reservations shall be heard by the Planning Commission at a public hearing and shall then be forwarded with their recommend- ations to City Council for final approval. (j) Wherein Planning Commission has Denied a Minor Subdivision, an applicant may appeal that decision to City Council in accordance with paragraph (d) of this section. Wherein Planning Commission has approved such a minor subdivision aggrieved adjacent grQperty owners may ap eal that decision to City Council in accordance with Paragraph d of this Section 2-~4. Present (h), (i) and (j) shall be relettered (k), (1) and (m). Section 2. Safet Clause. The City Council hereby finds, determines andeclares t at this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severabilit . If any clause, sentence, paragraph, or par- tot this or i_nance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 15 day(s) after ina~ 1 publication.
