ORDINANCE NO. 493
Series of 1982
TITLE: AN ORDINANCE RATIFYING LEASES OF REAL PROPERTY BETWEEN
THE ADOLPH COORS COMPANY AND THE CITY OF WHEAT RIDGE
TO BE UTILIZED BY THE CITY OF WHEAT RIDGE FOR PARK AND
OPEN SPACE PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
WHEREAS, on July 13, 1981, and October 20, 1981, the Adolph
Coors Company leased to the City of Wheat Ridge certain parcels
of real property for use by the City of Wheat Ridge for parks
and open space purposes for the respective terms of 25 years and
one-year annual renewable;
WHEREAS, it is deemed in the best interest of the parties for the
City to ratify and accept said Leases by ordinance.
NOW, THEREFORE, the City Council of the City of Wheat Ridge finds
as follows:
Section 1. The City Council of the city of wheat Ridge, acting as
the legislative body for the City of Wheat Ridge and pursuant to
Section 5.10 of the Home Rule Charter of the City of Wheat Ridge,
does hereby ratify and accept those certain Leases of real property
between the Adolph Coors Company, as Lessor, and the City of Wheat
Ridge, as Lessee, dated July 13, 1981, and October 20, 1981, for
respective terms of 25 years and one year with automatic annual
renewals. Said Leases have previously been accepted by said City
Council by motion, and the action taken herein is ratification of
said acceptance by ordinance. Copies of said Leases are on file
in the office of the City Clerk of the City of Wheat Ridge, and
shall be enforced pursuant to their respective terms.
Section 2. Safety Clause. The City Council hereby finds, deter-
mines and declares that this ordinance is promulgated under the
general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety and welfare of the public, and
that this ordinance is necessary for the preservation of health
and safety and for the protection of public convenience and wel-
fare. The City Council further determines that the ordinance
bears a rational relation to the proper legislative object sought
to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its appli-
cation to other persons or circumstances.
Section 4. This ordinance shall take effect 1 day after final
publication.
INTRODUCED, READ AND ADOPTED on first reading by a vote of _2
to 0 on this 26th day of April , 1982; ordered published
in full in a newspaper of general circulation in the City of Wheat
Ridge and Public Hearing and consideration on final passage set
for May 10 , 1982, at 7:30 o'clock p.m., at Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
