ORDINANCE NO. 498

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE PERMIT WITH
CONDITIONS IN A COMMERCIAL-ONE (C-1) ZONE ON LAND LOCATED AT
4949 MARSHALL STREET, WHEAT RIDGE, COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application of Lloyd Kiper for approval of a Special Use
Permit in Wheat Ridge, Colorado, Case No. SUP-82-5 and based on recommendation
for approval from the Wheat Ridge Planning Commission and pursuant to findings
made based on testimony and evidence presented at public hearing before the
Wheat Ridge City Council, a Special Use Permit for the operation of a garage
for repair of motor vehicles is hereby approved with conditions for the
following described land:
The Easterly 200 feet of the Southerly 100 feet of the following
described tract of land:
Beginning at a point on the West line of Block 20, BERKELEY HEIGHTS
SECOND FILING, 594.3 feet North of the Southwest corner of Section
13, Township 3 South, Range 69 West of the 6th P.M.; thence N74047'
E., 903.0 feet, more or less, to the Westerly right-of-way line of
State Highway No. 72; thence Northerly along said Westerly right-of-
way line 150 feet; thence Southwesterly 890 feet, more or less, to
a point on the West line of said Block 20, which is 200 feet North
of the point of Beginning; thence South along said West line 200
feet to the point of Beginning, EXCEPT any portion of subject
property lying within that parcel conveyed to Jefferson County by
Deed recorded in Book 405 at Page 423, Jefferson County Records,
together with an easement of ingress and egress 50 feet in width,
North of parallel and adjacent to the above described tract, all
in BERKELEY HEIGHTS SECOND FILING.
Section 2. The permitted uses of this Special Use Permit within the Commercial-
One (C-1 zone district for the parcel described above are conditioned as follows;
Garages for the repair of motor vehicles entirely within
an enclosed building.
2. The parking lot paving requirements are waived in lieu of the
special gravel conditions that exist in this area.
3. A 6 foot screening fence shall be constructed to conceal all
outside storage including vehicles in the state of repair.
Section 3. Safety Clause. The City Council hereby finds, determines and declares
that this ordinance is promulgated under the police power of the City of Wheat Ridge;
that it is promulgated for the health, safety, and welfare of the public, and that
this ordinance is necessary for the preservation of health and safety for the
protection of public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to these objectives.
Section 4. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ AND ADOPTED on first reading by a vote of 7 to 0 this
14th day of June 1982; ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consider-
ation on final passage set for ley 12th , 1982, 7:30 p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
