TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A REZONING FROM
RESIDENTIAL-ONE A (R-lA) AND AGRICULTURAL-ONE (A-1) TO
RESIDENTIAL-TWO (R-2) FOR LAND LOCATED AT APPROXIMATELY
4222 JELLISON STREET, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application by Terence and Glenda Gelston for approval of a
rezoning in Wheat Ridge, Colorado, Case No. WZ-82-11, and based upon recommenda-
tion for approval from the Wheat Ridge Planning Commission and pursuant to
findings made based on testimony and evidence presented at public hearing
before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to
exclude from the Agricultural-One and Residential-One A Districts and to
include in the Residential-Two District the following described land:
A parcel of land located in the NW 1/4 of the SW 1/4 of Section 22, Township
3 South, Range 69 West of the 6th Principal Meridian, County of Jefferson,
State of Colorado, being more particularly described as follows:
Beginning at the west 1/4 corner of said Section 22, thence N 90°00'00"
E on an assumed bearing along the North line of said NW 1/4 SW 1/4,
a distance of 638.Og feet to a point in the East line of Jellison
Street; thence S 00 53'00" E along the East line of Jellison Street,
a distance of 3$3.00 feet to the True Point of Beginning; thence
continuing S 00 53'00" E along the Eas8 line of Jellison Street,
a distance of 125 00 feet; thence S 69 33'25" E, a distance of
24.41 feet to a point on the West line of Iris Street; thence N
00 00'00" W along the West line of Iris Street, a distance of 180.00
feet, thence N 82°34'07" W, a distance of 231.95 feet, more or less,
to the True Point of Beginning, containing 0.800 acres, more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the preserva-
tion of health and safety and for the protection of public convenience and
welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of
this ordinance or the application thereof to any person or circumstances
shall for any reason be adjudged by a court of competent jurisdiction invalid,
such judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 1 day after final
publication
INTRODUCED, READ AND ADOPTED on first reading by a vote of 8 to _ 0 ,
this 11th day of October , 1982; ordered published in full in a newspaper
of general circulation in the City of Wheat Ridge and Public Hearing and
consideration on final passage set for November 8, 1982, 7:30 p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
