ORDINANCE N0. 538

TITLE: AN ORDINANCE AMENDING SECTION 4-1 OF THE CODE OF LAWS OF
THE CITY OF WHEAT RIDGE RELATING TO ANIMALS RUNNING AT
LARGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 4-1(j), Running at Large, of the Code of
Laws of the City of Wheat Ridge is hereby repealed and reenacted
as follows:
"(j) Running at large: Off the premises of the owner
and not under the effective control of that owner, his
agent, servant, or competent member of his family by
means of a leash, cord, or chain reasonable-gin NOT TO
EXCEED SIX (6) FEET IN length; except that, for purposes
of this definition, the "premises of the owner" shall not
include common areas of condominiums, townhouses and
apartment buildings, and any animal not in the effective
control of its owner upon the common area of a condominium,
townhouse or apartment building, or the grounds thereof,
shall be deemed to be running at large."
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated
under the general police power of the City of Wheat Ridge,
that it is promulgated for the health, safety, and welfare
of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of
public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any
person or circumstance shall for any reason be adjudged by a
court of competent jurisdiction invalid, such judgment shall
not affect, impair, or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 1 day(s)
after final publication.

8 to 0 on this 13th day of June , 1983;
ordered published in full in a newspaper of general circula-
tion in the City of Wheat Ridge and Public Hearing and considera-
tion on final passage set for July 18 , 1983, at 7:30
o'clock p.m., at Council Chambers, 7500 West 29th Avenue,
Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 7 to 1 this 18th day of
July , 1983.
