TITLE: AN ORDINANCE PROVIDING FORA THE APPROVAL OF REZONING FROM
RESIDEiiTiAL-THREE (R-3) TO RESTRICTED COiiiiERCIAL-OI4E (RC-1) ON LAND

Section 1. Upon application by health Care Properties I for approval of
rezoning in 'dl'reat Ridge, Colorado, Case Iuo. WZ44-20, and based capon
recommendation for approval, with conditions, froir tine idkreat Ridge Planning
Cunxni-ssion, and pursuant to findings iiiade based on testimony and evidence
presented at public hearing before the Wheat Ridge Planning Commission, and
pursuant to findings grade based on testimony and evidence presented at public
hearing before the wheat n1Uge City COUYICll, rriieau iSlCige rliapS are hereby
amended to exclude fror.i the Residential-Three (I-3) District and to include in
the Restricted Commercial-One (RC-1) District, the following described land:
Lots 12, 13, 14 and the South 2 feet of Lot 15, a subdivision of Block
COLUMT13IA HEIGHTS, also known as a Resubdivision of Block 5,
COLUMBIA IIETGNTS, according to the recorded plat thereof, together
with the east half of the vacated alley lying west of and adjacent to
the above described tract of land and bounded on the north by the
north line of the above described tract of land extended westerly and
bounded on the south by the south line of Lot 12 extended westerly,
County of Jefferson, State of Colorado.
Section 2. Conditions. No other Restricted Commercial-One (RC-1) uses other
than a nursing home be allowed but not to include facilities for mentally
disturbed, or developmentally disabled, or for the care and treatment of
animals.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof' to any person or circtmstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 22nd day of October , 1984, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for November 19 1984, at 7:30
o'clock p.m., in the Council Chambers, '7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISIIED on second and final reading by a vote of
