TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A
AGRICULTURAL-ONE (A-1) AND RESIDENTIAL-THREE
FACILITIES-ONE (PF-1) ON LAND LOCATED AT 4300
OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
CHANGE OF ZONE FROM
(R-3) TO PUBLIC
OAK STREET, CITY
COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application by Valley Water District for approval of a
rezoning from Agricultural-One and Residential-Three to Public
Facilities-One in Wheat Ridge, Colorado, Case No. WZ-85-8, and pursuant
to the findings made before the Wheat Ridge City Council, Wheat Ridge
Maps are hereby amended to exclude from the Agricultural-One Zone
District and Residential-Three (R-3) Zone District and to include in the
Public Facilities-One Zone District the following described land:
Tract 411- Beginning at a point 222 feet East and 89 feet North of
the SW corner of the SW 1/4 NE 1/4 of Section 21, Township 3 South,
Range 69 West of the 6th Principal Mer.; thence West 82.5 feet,
thence South 89 feet to the right-of-way of the irrigation ditch
running in a Northeasterly direction, thence Northeasterly along
said ditch right-of-way to a point which is 222 feet east of the
North-South centerline of said Section 21, thence North 51 feet more
or less to the point of beginning.
Tract 412- Beginning at a point 222 feet East and 38 feet North of
the center of Section 21, Township 3 South, Range 69 West of the 6th
Principal Mer., said point of beginning being the right-of-way of an
irrigation ditch running in a Northeasterly direction, thence North
130 feet, thence East 159.5 feet, thence South 67 feet more or less
to the right-of-way of said ditch, thence southwesterly along said
right-of-way to the point of beginning, except the East 10 feet
thereof, and all ditch right-of-ways.
Section 3. Safety Clause. The City Council hereby finds, determines,
and declares that this Ordinance is promulgated under the general policy
power of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this Ordinance is necessary
for the preservation of health and safety and for the protection of
public convenience and welfare. The City Council further determines
that the Ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part
of this Ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this Ordinance or its application to other
persons or circumstances.
Section 5. This Ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0
on this 17th day of June , 1985, ordered published in full in
a newspaper of general circulation in the City of Wheat Ridge and the
Public Hearing and consideration on final passage set for July 8 ,
1985, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue.
READ, ADOPTED, AND ORDERED PUBLISHED on second reading and final reading
by a vote of 8 to 0 , this 8th day of July_, 1985.
