ORDINANCE NO. 640

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-ONE (A-1) TO RESIDENTIAL-ONE C (R-1C) ON
LAND LOCATED AT APPROXIMATELY 4650 PARFET AND 4651 OAK
STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
COLORADO.
WHEREAS Applicants William D. Braun, Chris D. Braun, Franz
J. Russell and Gisela Russell have heretofore brought suit
against the City of Wheat Ridge relating to the property in
question;
WHEREAS the parties, by Stipulation dated July 31, 1985,
have agreed that the within property shall be rezoned from the
Agricultural-One (A-1) zone district to Residential-One C (Rl-C);
WHEREAS in consideration of said Stipulation Applicants have
agreed to dismiss Civil Action 84CV2368 and their appeal in Case
84CA0921;
WHEREAS said Stipulation, having been agreed to by the City
Council of the City of Wheat Ridge, the City Council does hereby
take the following action in implementation thereof;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Pursuant to the stipulations described above,
the City Council of the City of Wheat Ridge does hereby declare
that Wheat Ridge zoning maps are hereby amended to exclude from
the Agricultural-One (A-1) and to include in the Residential-One
C (Rl-C) zone district the following described land:
LOTS 1, 2, 3, BUSH SUBDIVISION.
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 3. Severability. If any clause, sentence,
paragraph, or part of this ordinance or the application thereof
to any person or circumstances shall for any reason be adjudged
by a court of competent jurisdiction invalid, such judgment shall
not affect application to other persons or circumstances.
Section 5. This ordinance shall take effect I days
after final publication.

in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for nc-tnhar 28 , 1985, at
7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 8 to 0 this 2gth day of nctnh.,
