TITLE: A;v ORDIIJANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-ONE TO RESIDENTIAL TWO-A ON LAND LOCATED AT
APPROXIMATELY 10500 SOUTH I-70 SERVICE ROAD, CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED 3Y TliE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by Chris Dody for approval of rezoning
in Wheat Ridge, Colorado, Case No. 1,4Z-85-15, and pursuant to
findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are
hereby amended to exclude from the Agricultural-One District and to
include in the Residential Two-A District, the following described
land:
Beginning at a point on the north line of the north one-half of
the northwest one-quarter of the northeast one-quarter of
Section 21, Township 3 South, Range 69 West of the 6th
Principal Meridian, whence the northeast corner of said north
one-half Df the northwest one-quarter of the northeast
one-quarter bears N89040'3011E a distance of 331.60 feet; thence
S0000113011E a distance of 248.00 feet; thence S89040'30"W a
distance of 308.76 feet to a point on the east right-of-way
line of Nelson Street; thence N0000414411W on and along said
right-of-way line a distance of 128.00 feet; thence departing
said right-of-way line 1189040'3011E a distance of 15.00 feet;
thence 310000414411W a distance of 120.00 feet to a point on the
north line of said north one-half of the northwest one-quarter
of the northeast one-quarter; thence N89040'3011E on and along
the north line of said north one-half of the northwest
one-quarter of the northeast one-quarter a distance of 294.00
feet, more or less, to the Point of Beginning, containing 1.717
acres, more or less.
Section 2: Conditions.
1. Development on this property be limited to sixteen units.
2. Prior to issuance of any building permits for this property, a
Planned Building Group (PBG) plan must be submitted for review
and approval subject to normal procedure for such approval.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such ordinance or its application to other persons
or circumstances.

Section 5. This ordinance shall take effect 15 days after final
publication.

on this 16th day of Demme-tber 1985, Ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public
Hearing and consideration on final passage set for Tan„arm 11 ,
1986-, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.

vote of 8 to 0 , this 13th day of January , 1986.
