TITLE: AN ORDINANCE PROVIDING FOR THE APPROZIAL OF A SPECIAL USE
PERMIT TO ALLOW TRUCK TRACTOR PARKING ON LA~ID LOCATED AT
3270 YOUNCFIELD, CITY OF WHEAT RID E, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAIi1ED BY THE CITY COUNCIL OF `tL CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by Quality Inn-West for approval of a
7pec1a Use Permit to allow truck tractor parking in Wheat Ride,
Colorado, Case No. SUP-85-11, with conditions, and pursuant to
findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are
hereby amended to designate this property as having a Special Use
Permit. Said property is described as follows:
That part of the Southeast Quarter of the Northwest Quarter of
Section 29, Township 3 South, Range 69 West of the Sixth
Principal Meridian, in the City of Wheat Ridge, Jefferson
County, Colorado, described as commencing at the West
Quarter-Corner of said Section 29, running thence North
89047'32" East along its East-'des' Midsection Line 1,394.79
feet, more or less, to its intersection with the East
right-of-way line of Youngfield Street; thence North 00051'48"
West along said right-of-way line 180.00 feet to the true Point
of 13eginni.nJ; thence continuing along the East right-of-way
line of Youngfield Street, "North 00051'48" :lest ')74.32 feet;
thence North 89031112" East 140.00; thence North
00051148" WesL, parallel with the East right-of-way line
of Youngfield Street, 175.69 feet; thence North 39031112" East
150.00 feet; thence South 00051148" East, parallel with the
East right-of-way line of Youngfield Street, 450.00 feet;
thence South 89031112" West 290.00 feet
to the true Point of Aeginnin.g.
Section 2: Conditions.
(1) Truck tractor parkin; shall be in accordance with the attached
site plan labeled Exhibit "A".
(2) The number of spaces shall be limited to six (6).
(3) No overnight running of motors shall be allowed.
(4) The Special Use Permit shall be for a term of one (1) year and
shall be automatically renewable each year thereafter by the
Director of Community Development upon receipt of an application
for renewal if, following review of the files of all City
departments, it is determined that no written verifiable complaints
during the term of the Special Use Permit have been received.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general. police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such ordinance or its application to other persons
or circumstances.

Section 5. This ordinance shall take effect immediately after final
publication.
YNTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 1
on this 13th day of January , 1986, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public
Nearing and consideration on final passage set for January 27 ,
1986, at 7:30 o'clock p.m., in the Council Chambers, 7500 west 29th
Avenue, Wheat Ridge, Colorado.
