DEVELOPMENT AND FOR APPROVAL OF A COMBINED OUTLINE AND
FINAL DEVELOPMENT PLAN AND PLAT ON LAND LOCATED 'T 6161
WEST 48TH AVENUE, CITY OF 14HEAT RIDGE, COUNTY OF
JEF'.ERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 61IHEAT RIDGE, COLORADO,
THAT:
Section 1: Upon application by Public Storage Company for
approval of rezoning in ]heat Ridge, Colorado, Case No. WZ-85-31
and based upon recommendation for approval from the .4heat Ridge
Planning Commission, and pursuant to findings made based on
testimony and evidence presented at public hearing before the
Wheat Ridge City Council. Wheat Ridge maps are hereby amended to
excluded from the Commercial-One and Residential-Two Districts and
to include in the Planned Commercial Development District, and
approval of a combined outline and final development plan and
plat, for the following described land:
A tract of land in the SW 1/4 of Section 13, Township 3 South,
Range 69 West of the 6th P.M., City of Wheat Ridge, County of
Jefferson, State of Colorado, being more particularly described
as follows:
Commencing at the South 1/4 Corner of said Section 13, thence
westerly along the south line of the southwest 1/4 of said
Section 13, said line also being the centerline of West 48th
Avenue, a distance of 440.50 feet; thence on a deflection angle
right of 90000100" a distance of 30.00 feet to a point on the
northerly right-of-way of said 48th Avenue, said point also
being the true point of beginning; thence on a deflection angle
left of 00012'30" a distance of 311.36 feet to the southerly
line of 3lock 19, Berkely Heights Subdivision, Second Filing,
of Jefferson County Records, said line also being the edge of a
bluff; thence on a deflection angle left of 124035143" and along
said edge of bluff and said southerly line of Block 19, a
distance of X92.28 feet; thence on a deflection angle left of
54056'39" a distance of 644.13 feet to a point on the northerly
right-of-way line of West 48th Avenue; thence on a deflection
angle left of 90015108" and along the said northerly
right-of-way a distance of 246.39 feet to the true point of
beginning.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general police
power of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is necessary
for the preservation of health and safety and for the protection of
public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to the proper legislative
object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.

1986, at 7:30 o'c1ocV P.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
