HomeMy WebLinkAboutOrdinance-1986-0660INTRODUCED BY COUNCILMEMBER KELLER 0_ LUI ANCE NO. 660 Series of 1986 TITLE: AN ORDINANCE APPROVING A LEASE PURCHASE AGREEMENT BETWEEN THE CITY OF WHEAT RIDGE AND BORG-WARNER LEASING, A DIVISION OF BORG-WARNER ACCEPTANCE CORPORATION, FOR THE FIVE YEAR LEASE PURCHASE OF A PEABODY MYERS VACTOR MODEL 810/800 COMBINATION JET RODDER/VACUUM UNIT WHEREAS, Section 12.9 of the Home Rule Charter of the City of Wheat Ridge request that any lease/purchase of equipment by the City of Wheat Ridge be approved by Ordinance adopted by the City Council of the City of Wheat Ridge; WHEREAS, the City Council of the City of Wheat Ridge has previously budgeted for, and approved the acquisition of, a Peabody Myers Vactor Model 810/800 Combination Jet Rodder/Vacuum Unit for a total cost of $117,078.00; WHEREAS, the City may lease said equipment, with an option to purchase the same, over a five year period in equal monthly installments of $2,398.93; WHEREAS, the City wishes to approve the lease purchase agreement described herein and, subject to the terms of said lease purchase agreement, authorize the monthly payments described above; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1. The Lease Purchase Agreement between the City of Wheat Ridge and Borg-Warner Leasing, a division of Borg-Warner Acceptance Corporation, a copy of which is attached hereto as Exhibit A and expressly incorporated herein, is hereby ratified and adopted by this Ordinance, subject to the terms hereof. The Mayor and City Clerk are hereby authorized to execute said Lease Purchase Agreement, following its approval as to form by the City Attorney. Section 2. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the Citv of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. This ordinance shall take effect one (1) day after final publication.
