HomeMy WebLinkAboutOrdinance-1986-0661INTRODUCED BY COUNCIL MEMBER - KELLER _ ORDINANCE NO. 661 Series of 1986 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RESIDENTIAL-THREE TO PLANNED COiMMERCIAL DEVELOPMENT AND FOR APPROVAL OF A COMBINED OUTLINE AND FINAL PLAN AND PLAT ON LAND LOC9TFD A'i APPROXIMATELY 9701 WEST 50TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAIi1ED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1: Upon application by Equity Builders for approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-85-19, and based upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based upon testimony and evidence presented at public hearing before the Wheat Ride City Council, Wheat Ridge maps are hereby amended to exclude from the Residential-Three District and to include in the Planned Commercial Development District and for approval of a combined outline and final plan and plat, the following described land: A portion of the southwest 1/4 of Section 15, Township 3 South, Range 69 West of the 6th Principal Meridian, described as follows: Beginning at the northeast corner of Lot 5, Kipling 5000 Business Dark Filing ^Jo. 3, said point also being the true point of beginning of the herein described parcel; Thence S 10025100" W and along the east line of Kipling 5000 Business Park Filing No. 3 a distance of 442.16 feet to the north right-of-way line of west 50th Avenue, thence N 74008144" E along said ri;;it-of-way line 675.21 feet to a point of curve; thence along said curve to the left having a radius of 208.54 feet, an arc distance of 270.08 feet; thence leaving said right-of-way line P1 88044'56" W a distance of 2417.81 feet- thence "1 02012'00" a distance of 39.50 feet; thence N 88644156" W a distance of 378.72 feet to the point of beginning. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. This ordinance sha11 take effect 1_ days after final publication.
