TITLE: Ali ORDINANCE PROVIDING FOR THE APROVAL OF A SPECIAL USE
PERMIT TO ALLOW GASOLINE SALES IN A COMMERCIAL-ONE ZONE
DISTRICT ON LAND LOCATED AT THE NORTHWEST CORNER OF WEST
44TH AVENUE AND HOLLAND STREET, CITY OF WHEAT RIDGE, COUNTY
OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CI'T'Y COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by Meridian Land Cornpany for
approval of a Special Use Permit in Wheat Ridge, Colorado, Case No.
SUP-36-11 and based upon recommendation for approval from the Wheat
Ridge Planning Commission, and pursuant to findings made based on
testimony and evidence presented at public hearing before the Wheat
Ridge City Council, Wheat Ridge maps are hereby amended to
designate approval of a Special Use Permit to allow gasoline sales
on the following described land:
A parcel of land located in the 111d 1/4 of Section 22, Township
Three South, Range 69 'west, of the 6th Principal Meridian, City
of Wheat Ridge, County of Jefferson, State of Colorado more
precisely described as follows: Beginning at a point of
reference aL Center line of Holland Street which is 660.890
feet from East line of PIW 1/4 Section 22; thence westerly and
along the north right-of-way (ROW) line of West 44th Avenue
30.00 feet to the true point of beginning; thence continuing
along the North (ROW) line of the West 44th Avenue for 300.430
feet to the Southwest corner; thence northerly with an internal
angle of 90011100" and along the west side of lots #1 and #2
for a distance of 412.320 feet to the Northwest corner; thence
easterly with an internal angle of 90009115" and along the
south ROW line of West 45th Avenue a distance of 300.38';
thence southerly with an internal angle of 89051110" and along
the West ROW Holland Street for a distance of 414.090' to the
southeast corner of said point of beginning, containing 2.848
acres more or less. The Northeast and Southeast corners have
radius of 15 feet for street intersections.
Section 2. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power
of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is
necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
