TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 21-21 AND
SECTION 21-1-.3 OF CHAPTER 21, ARTICLE II OF THE CODE OF
THE CITY 0. .!HEAT RIDGE, COLORADO PERTAINING TO TAXATION
OF TELEPHOi:;~ EXCHANGES.
BE IT ORDAINED BY ThE' ',ITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Sectio., 21-21 of Chapter 21, Article II of the Code
of the City of Wheat Ridge, Colorado, is hereby repealed and
reenacted as follow,:
Section 21-21. Levied.
There is he.•eby levied against every telephone utility
which is engaged in the business of furnishing local
exchange of telephone service within the city a tax on
the privileg of engaging in such business. The amount
of such tar :hall be $127,050.00.
Section 2. Section. 21-23 of Chapter 21, Article II of the Code
of Laws of the City of Wheat Ridge, Colorado, is hereby repealed
and reenacted as follows:
Section 21-23. Payment.
The tax shall be payable in twelve (12) equal monthly
installments; each installment to be paid on the last
business d y of each calendar month.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police lower of the City of Wheat Ridge; that it is
promulgated for the health, safety and welfare of the public, and
that this ordinance is necessary for the preservation of health
and safety and for, the protection of public convenience and
welfare. The City "ouncil further determines that the ordinance
bears a rational rr_.:t ~n to these objectives.
Section 4. Severab_iity. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person
or circumstances sh.sll for any reason be adjudged by a court of
competent jurisdicE- ion invalid, such judgement shall not affect,
impair or invalidat the remainder of this ordinance or its
application to other ;,ersons or circumstances.
Section 5. This ordinance shall become effective January 1,
1987.
