TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE
PERM IT TO ALLOW GASDLINE SALES ON LAND LOCATED AT THE
NORTHEAST CORNER OF KIPLING AND wiEST 38TH AVENUE, CITY OF
UHEAT RIDGE, COUNTY OF JEFPERSOJ, STATE OF COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section _1. Upon application by Circle K Corporation for approval
of a Special Use Permit in Wheat Ridge, Colorado, Case No.
SUP-36-20, and based upon recommendation for approval from the
Wheat Ridge Planning Commission, and pursuant to findings made
based on testimony and evidence presented at public hearing before
the Wheat Ridge City Council, a Special Use Permit to allow
gasoline sales in a Commercial-One Zone District is hereby approved
for the following described land:
The North 110 feet of the South 140 feet of the East 201.3 feet
of the West 231.3 feet of the Southwest 1/14 of Section 22,
Township 3 South, Range 69 West of the 6th P.M., EXCEPT that
portion of the above described property conveyed to Colorado
State Highway Department in deed recorded in Book 2153 at Page
773; EXCEPT that portion conveyed in deed recorded November 10,
1972, in Book 2444 at Page 378, County of Jefferson, State of
Colorado.
Plus the southerly 45 feet of Lots 1, 2 and 3, Hillside
Subdivision.
EXCEPT that portion of the above described property conveyed tc
Colorado State Highway Department in deed recorded in Book 215=
at Page 773, County of Jefferson, State of Colorado.
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of '41neat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
---8- to --0-- on this _9th- day of -February 1987, ordered
published in full in a newspaper of general circulation in the City
of 4heat Ridge and Public Hearing and consideration on final
passage set for -March _91987, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat ftid~e, Colorado,
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 8 to 0 thi3 _9th day of March , 1937.
