TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM RESTRICTED-COMMERCIAL AND COMMERCIAL-ONE TO
COHI-IERCIAL-ONE ON LAND LOCATED AT 9160 l'JEST 44TH
AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE.
OF COLORADO.

COLORADO, THAT:
Section 1. Upon application by Anthony Perko for approval of
rezoning in Wheat Ridge, Colorado, Case No. WZ-87-8, and based
upon recommendation for approval from the Wheat Ridge Planning
Commission, and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge
City Council, Wheat Ridge maps are hereby amended to exclude
from the Restricted-Commercial and Commercial-One Zone
Districts and to include in the Commercial-One Zone District,
the following described land:
PARCEL I
That portion of the southwest 1/4 northeast 1/4 of Section
22, Township 3 South, Range 69 west, described as follows:
Commencing at the point of intersection of the west line of
said southwest 1/4 northeast 1/4 and the south right-of-way
line of West 44th Avenue, thence east along the south
right-of-way line of West 44th Avenue 128 feet to the true
point of beginning; thence south and parallel with the west
line of said northeast 1/4 300 feet; thence east and
parallel to the south right-of-way line of West 44th
Avenue, 125 feet; thence north and parallel to the west
line of said northeast 1/4, 300 feet to a point on the
south right-of-way line of West 44th Avenue; thence west
along the south right-of-way line of West 44th Avenue, 125
feet, more or less, to the point of beginning. County of
Jefferson, State of Colorado.
PARCEL II
The east 8 feet of the following described property, a
parcel of land located in the southwest quarter of the
northeast quarter of Section 22, Township 3 South, Rant,e 69
West, Commencing at the point of intersection of the west
line of the southwest 1/4 northeast 1/4 and the original
south line of West 44th Avenue; thence south along the west
line of said southwest 1/4 northeast 1/4 a distance of 300
feet, thence east 128 feet; thence north to the original
line of West 44th Avenue; thence west along the original
line of West 44th Avenue a distance of 128 feet, more or
less to the point of beginning. County of Jefferson, State
of Colorado.

Section 2. Condition. A 6 foot high screening fence be
constructed along the southerly property line.
Section Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 5. This ordinance shall take effect 15-- days after final
publication.
INTRODUCED, READ, A14D ADOPTED on first reading by a vote of
to _ 0 _ on this _24th day of August , 1987, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public hearing and consideration on final
passage set for September 23 , 1937, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 7 to 0 , this 28th day of September , 1987.
