HomeMy WebLinkAboutOrdinance-1987-0737INTRODUCED BY COUNCILMEMBER IBBISON Ordinance No. 737 Series of 1987 TITLE: AN ORDINANCE AMENDING ORDINANCE NO. 727, SERIES OF 1987, BY AMENDING THE AREA INCLUDED WITHIN THE "MORATORIUM AREA" CONCERNING PROPERTIES WITHIN AND ADJACENT TO THE WADSWORTH TOWN CENTER AS CREATED IN SAID ORDINANCE NO. 727. WHEREAS, the City Council has previously adopted Ordinance No. 727, Series of 1987, establishing a building and zoning moratorium within a "moratorium area" within and adjacent to the Wadsworth Town Center within the City of Wheat Ridge, Colorado pending approval of a Wadsworth Town Center Redevelopment Plan; WHEREAS, negotiations have progressed with the designated developer relating to acquisition and development of properties within said "moratorium area" and the Wadsworth Town Center; WHEREAS, based upon said negotiations, it appears to the City Council that the best interests of the citizens of the City of Wheat Ridge and those property owners who own property lying south of the southern boundary of the Currier Minor Subdivision would best be served by eliminating said properties from the "moratorium area." NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1. Section 1 of Ordinance No. 727, Series of 1987, specifically Section 1, "Moratorium Area" thereof, is hereby repealed and reenacted as follows: Section 1. Moratorium Area. The provisions of this Ordinance shall apply to that portion of the City of Wheat Ridge described as follows: All commercially zoned properties lying south of West 44th Avenue and north of the southern boundary of the Currier Minor Subdivision. This area of land shall hereinafter be referred to as the Moratorium Area. Section 2. Except as specifically amended herein, the provisions of Ordinance No. 727, Series of 1987, are hereby reaffirmed and reenacted. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 5. This ordinance shall take effect one (1) day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0 on this 12th day of October , 1987, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for Monday, October 26 , 1987, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading by a vote of 6 to 1 this 26th day of October 1987.
