HomeMy WebLinkAboutOrdinance-1988-0757INTRODUCED BY COUNCILMEMBER KELLER Ordinance No. 757 Series of 1988 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION 14-47 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Section 14-47 of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: Sec. 14-47. Harassment. It is unlawful for any person, with intent to harass, annoy or alarm another person, to: (a) Strike, shove, kick or otherwise touch a person or subject him to physical contact. (b) In a public place, direct obscene language or make an obscene gesture to or at another person where such language or gesture either causes injury or tends to invite an immediate breach of the peace. (c) Follow a person in or about a public place or places. (d) eommunleate w4:th a person; anonymously or etherw+se; by telephone; telegraph; xtall or any ether form of eexntlnleat}en; In a manner ll#ely to harass or eadse alarmT INITIATE COMMUNICATION WITH ANOTHER, ANONYMOUSLY OR OTHERWISE, EITHER IN PERSON OR BY TELEPHONE, IN A MANNER INTENDED TO HARASS OR THREATEN BODILY INJURY OR PROPERTY DAMAGE, OR WHICH INCLUDES ANY COMMENT, REQUEST, SUGGESTION, OR PROPOSAL WHICH IS OBSCENE. (e) Make a telephone call or cause a telephone to ring repeatedly, whether or not a conversation ensues, with no purpose of legitimate conversation. (f) Make repeated communications at inconvenient hours or in offensively coarse language. (g) Repeatedly insult, taunt or challenge another in a manner likely to provoke a violent or disorderly response. (h) Engage in eenduet or repeatedly eemmit nets that alarm or seriedsly annoy another person and that serge no legitimate purpose- COMMIT ANY TWO OR MORE OF THE ACTS SPECIFIED IN THIS SECTION 14-47 AGAINST THE SAME PERSON. Section 2. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. This ordinance shall become effective 15 day(s) after final publication.
