TITLE: AN ORDINANCE VACATING A PORTION OF OTIS STREET IN
THE JAMES SUBDIVISION WITHIN THE CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
WHEREAS a portion of the James Subdivision, previously approved
by the Board of County Commissioners of Jefferson County, contains a
dedication adjacent to Lot 33 of said James Subdivision; and
WHEREAS a portion of said dedicated Otis Street lies within a
cul-de-sac bulb and is unneeded for public roadway purposes; and

WHEREAS said part of said Otis Street lies within the City of
Wheat Ridge, County of Jefferson, State of Colorado, and is not needed
by the City for roadway or right-of-way purposes;
B8 IT ORDAINEu BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO AS FOLLOWS:
Section 1. The following portion of Otis Street, a dedicated
street within the City of Wheat Ridge, County of Jefferson, State of
Colorado, with the James Subdivision, is hereby vacated, to wit:
A parcel of land being a portion of Otis Street, westerly of Lot
33, James Subdivision, a plat recorded in Jefferson County in
Plat Book 8 at Page 15, situated in a portion of the west one-
half of the southwest one-quarter of Section 24, Township 3
South, Range 69 West of the Sixth Principal Meridian, County of
Jefferson, State of Colorado, more particularly described as
follows:
Commencing at the southwest corner of said Lot 33, said
point being on the east right-of-way line of said Otis
Street, said point being the True Point of Beginning; thence
North 90000'00" West a distance of 8.45 feet; thence North
00010'00" West A distance of 67.49 feet to a point of
curvature on the west line of said Lot 33 and the East
right-of-way line of said otis Street; thence along the arc
of a curve to the right, along the west line of said Lot 33
and the east right-of-way line of said Otis Street, having a
central angle of 98013'41", a radius of 45.00 feet and an
arc length of 77.15 feet, whose chord bears south 07018'41"
East a distance of 68.04 feet to the True Point of
Beginning. Containing 1,019 square feet or 0.0234 acres
more or less.
Providing, however, that there is reserved to the City of Wheat Ridge
solely for the benefit of utility providers and not for street
purposes, an easement in and from property described herein which
easement may be utilized solely for utility installation and
maintenance.

Section 2. Upon the vacation accomplished hereby, title to the
property vacated shall revert by operation of C.R.S. 1973, 43-2-02 to
the owner of record of Lot 33, James Subdivision.
Section 3. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general /)
police power of the City of Wheat Ridge, that it is promulgated for ~
the health, safety, and welfare of the public, and that this Ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the
proper legislative object sought to be attained.
Section 4. Severabilitv. If any clause, sentence, paragraph, or part
of this Ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 5. This Ordinance shall take effect one day after final
publication.

Public Hearing and consideration on final passage set for
May 13 , 1991, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
