HomeMy WebLinkAboutOrdinance-1993-0924 INTRODUCED BY COUNCIL MEMBER Council Bill No. 8 ORDINANCE Series of 1993 SELSTAD NO. ---.9Z!l TITLE: AN ORDINANCE AMENDING THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, COLORADO REGARDING PARKING OF RECREATION VEHICLES AND TOWED VEHICLES WITHIN PUBLIC STREET RIGHTS-OF-WAY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Wheat Ridge Code of Laws, Section 26. Zoning and Development, Subsection 31. Off-Street parking requirements, subpart (B)(6)(b) is hereby amended as follows: "(b) In residential zone districts, motor homes or recreational vchiclc3, wh~ arc cither eight (8) feBt or more in width or tHenty fivc (25) feet or more in lcngth, motorized and nonmotorized camping vehicles, (except campers mounted upon pickup trucks) trailer mounted boats, and other towed vehicles such as but not limited to utility trailers, shall not be parked within public street right-of-way for a period longer than seventy-two (72) hours, however may be parked or stored upon ~ property owned by ~ the vehicle owner, or if said vehiclcs are owned by anyone othcr -'than the-property OHner Hhere parked, said motor vehiclcs or rccrcational vehicles may be stored or par}{cd on said private property ,vi th the knoHledgc and consent of the property OHncr; provided, that no more thaft tom (2) 3uch vehicles are stored on any Stich lot or parcel at anyone (1) timeT ftftd provided said vehicles are parked six (6) feet or more inside the front property line. Where it is difficult to determine the public right-of-way boundary due to lack of curb, gutter and/or sidewalk, or survey makers, such boundaries shall be presumed to be ten (10) feet from the edge of pavement or back of curb. In cases where it is desired to maintain a-+arge motor homc or recreatio~ such a restricted vehicle either within six (6) feet of a public street on private property or within a lawful parking area on a public street abutting the front of the property in excess of twenty four (247 seventy-two (72) hours, the property owner may obtain a temporary parking permit from the planning and development department. Such temporary parking permit shall be for a time period not to exceed fourteen (14) days, and no more than one (1) such permit shall be issued each six (6) months for the same vehicle propert~. The permit must be placed upon the inside windshield or side-window on the driver's side so as to be visible for inspection. Pickup truck mounted campers, when mounted upon pickup trucks, are not subject to these ~ subpart (b) parking restrictions. Nothing in this ordinance will be construed to restrict or limit parking of any vehicle so described within this ordinance upon private property so long as said vehicle is parked in accordance with the limitations of this subpart (b). no closer tA~~eet of aRy--f)aVed public 3treet." Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severabilitv. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Ordinance No. 924 -- Series of 1993 Page 3 Section 4. This Ordinance shall take effect ~ days after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to ~ on this 8th day of March , 1993, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for April 12 , 1993, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado. 4/12/93 - Motion to postpone until April 26, 1993; carried 7-1.
