HomeMy WebLinkAboutOrdinance-1993-0937 INTRODUCED BY COUNCIL MEMBER VANCE EDWARDS Council Bill No. 26 ORDINANCE NO. 937 Seriesof 1993 TITLE: AN EMERGENCY ORDINANCE AMENDING THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE, COLORADO, TO ADOPT A MORATORIUM, FOR NINETY DAYS, PREVENTING THE OPENING OF ANY NEW PAWNBROKER'S BUSINESSES WITHIN THE CITY OF WHEAT RIDGE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: WHEREAS, the City Council of the City of Wheat Ridge has been made aware of the opening of several pawnbrokers' businesses within the City limits of the City of Wheat Ridge; and WHEREAS, the City Council of the City of Wheat Ridge has been made aware of public health, safety, and welfare concerns associated with the operation of these types of businesses, including the need for increased police contact with these types of businesses, and the need for regulation of these types of businesses; and, WHEREAS, the City Council of the City of Wheat Ridge is presently engaged in drafting and enacting regulations which will govern the operation these types of businesses in the future; and 6'i: WHEREAS, it is in the interest of the public health, safety, and welfare that no new pawnborkers' businesses be permitted to open and operate in the City until such regulations are enacted. NOW, THEREFORE, the City Council, by a majority vote and within the powers granted by Section 5.13 of the City Charter, does hereby temporarily amend the Code of the City of Wheat Ridge in all applicable sections to accomplish the following: Section 1. Emerqencv amendment to all applicable Code provisions. The City Council hereby amends, for a period of ninety (90) days, and pursuant to the authority granted by Section 5.13 of the City Charter concerning emergency ordinances, all applicable City Code sections and Charter provisions in such a manner as to deny and prevent the opening of any new pawnbroker's business within the City limits of Wheat Ridge. With the specific exception of those pawnbrokers' businesses which are presently open and operating, and with the understanding that this exception is limited to the present locations of those businesses, this emergency ordinance is intended to make the use of any property for pawnbroking within the City temporarily prohibited. No business licenses, building permits, or certificates of occupancy shall be issued for such businesses until this ordinance either expires by its own Ordinance No. 937 Series of 1993 Page 2 terms, or is superceded by a subsequent ordinance enacted by the City Council, whichever comes first. Section 2. Safetv Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be obtained. section 3. Severabilitv. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person of circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance or its application to other persons or circumstances. Section 4. This Ordinance shall take effect upon passage.
