HomeMy WebLinkAboutOrdinance-1994-0963 - - RECEPTION NO. 94089520 15,00 RECORDED IN COUNTY OF JEFFERSON STATE OF COLORADO 5/17/94 9:47 ~( ~/ \1.; // INTRODUCED BY COUNCIL MEMBER EDWARDS Council Bill 51 ORDINANCE NO. 963 Series of 1994 TITLE: AN ORDINANCE VACATING A PORTION OF FIELD STREET EXTENDED BETWEEN FIELD AND FLOWER STREETS AT APPROXIMATELY 3401 FIELD STREET, WITHIN THE CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. ,-~ I WHEREAS, right-of-way was previously dedicated for Field Street extended between Field Street and Flower street at approximately 3401 Field Street; and WHEREAS, said part of Field Street lies within the City of Wheat Ridge, County of Jefferson, State of Colorado and, a portion of said right-of-way is inundated by the waters of Lake Henry Lee North Reservoir; and WHEREAS, said right-of-way is not needed by the City for roadway or right-of-way purposes; and BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1. dedicated street Jefferson, State The following portion of Field Street, a within the City of Wheat Ridge, County of of Colorado, is hereby vacated, to wit: A tract of land lying in the NE 1/4 of Section 27, Township 3 South, Range 69 West of the 6th Principal Meridian, City of Wheat Ridge, County of Jefferson, State of Colorado, described as follows: THAT PORTION OF THE UNNAMED STREET NORTH OF AND ADJACENT TO LOTS 16 AND 23 OF GOODHART-STODDARD SUBDIVISION, LYING AND BEING SOUTHEASTERLY OF THE NORTHERLY EXTENSION OF THE WEST LINE OF SAID LOT 16 AND NORTH OF THE NORTH LINE OF SAID LOT 16, AND NORTH OF THE NORTH LINE OF SAID LOT 23 AND ITS EXTENSION EASTERLY TO THE EAST LINE OF FIELD STREET. TOGETHER WITH THAT PORTION OF FIELD STREET LYING NORTH OF A LINE FROM THE PCR ON THE EAST LINE OF LOT 23 OF GOODHART-STODDARD SUBDIVISION TO THE PCR ON THE WEST LINE OF LOT 24 OF GOODHART-STODDARD SUBDIVISION. SAID GOODHART- STODDARD SUBDIVISION BEING RECORDED IN THE OFFICIAL RECORDS OF THE COUNTY OF JEFFERSON, STATE OF COLORADO AT PLAT BOOK 7 PAGE 46. Said tract containing 15,230 square feet more or less. Section 2. Upon the vacation accomplished hereby, title to the property vacated shall revert by operation of C.R.S. 1973, 43-2-302 to the adjacent property owners of record. Ordinance No. 963 Series of 1994 Page 2 Section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under ~l the general police power of the City of Wheat Ridge, that it is ~~ promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This Ordinance shall take effect one day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to ~ on this 11 th day of April , 1994, ordered published in full in a newspaper of general circulation in the City of Wheat Ridge and Public Hearing and consideration on final passage set for May 9 , 1994, at 7:00 o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
