TITLE:
AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM PLANNED RESIDENTIAL DEVELOPMENT DISTRICT TO AN
AMENDED PLANNED COMMERCIAL DEVELOPMENT DISTRICT AND
APPROVAL OF A COMBINED OUTLINE AND FINAL DEVELOPMENT
PLAN ON LAND LOCATED AT 4140 YOUNGFIELD, CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by ~)tep!len Casement for Tri-KB Investments for
establishment of an amende:, (:0 nmercial development zone district and
approval of a final development plan in Wheat Ridge, Colorado, Case No. WZ-94-
16 and based on recommendatio,l for approval from the Wheat Ridge Planning
Commission, and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council, a new Planned
Commercial Development zone district is established and a combined outline and
final planned commercial develoument plan is hereby approved for the following
described land:
Lot 4, Youngfield Plaza Pha~'" iL":it\, of Wheat Ridge, County of Jefferson, State
of Colorado
Section 2. Condition. On Lui 4 Rt:creational Vehicle sales be allowed in addition
to the previously-allowed uses c',tablished per Youngfield Plaza Phase II Outline
and Final Development Plan conveision to any type of auto-related sales is
prohibited.
Section 3. Vested Prgperty Righ\s Approval of this rezoning does not create a
vested property right. Vestecj property rights may only arise and accrue
pursuant to the provisions ot Se( tion 26(c) of Appendix A of the Code of Laws of
the City of Wheat Ridge
