WHEREAS, the City Council believes it to be in the public interest of the residents of and visitors to the City that addi- tional safety and comfort be made available to patrons of the public transit system of the Regional Transportation District within the City, by permitting the installation of bus stop shelters; and WHEREAS, the City Council and standards for the placement, removal of bus stop shelters. wishes to establish guidelines maintenance, permitting and BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, AS FOLLOWS: Section 1. Chapter 21, Article IV of the Wheat Ridge Code of Laws, entitled "Courtesy Benches," is amended to read: "Courtesy Benches and Bus Stop Shelters," Section 2. Laws is amended by the follows: Section 21-124 of the Wheat Ridge Code of addition of a new subsection (f) to read as (f) No courtesy bench with advertising shall be permitted in any location for which a permit for a bus stop shelter with advertising has been issued pursuant to Section 21-151. Section 3. The Wheat Ridge Code of Laws is amended by the addition of a new Section 21-151, to read as follows: Sec. 21-151. Bus Stop Shelters The City may provide for the erection of bus stop shelters directly by the City, by contract, agreement, or otherwise, All such bus stop shelters shall be constructed In compliance with the requirements of the Americans With Disabilities Act. If erected by contract or agreement with a private com- pany, the terms of such contract or agreement shall govern the placement of such shelters, provided, however, that all such shelters shall comply with the following requirements of this Article IV (wherein all references to "courtesy benches" shall be deemed by this reference to include "bus stop shelters)": GED\S3027\133nlR 2 (1) Location: Section 21-124(b); provided however, the City may deny permission to locate a bus stop shelter at a specific location for any reason, (2) Zones In which advertising matter is permitted: Section 2l-124(d); provided, however, if located within any residen- tial zone district, bus stop shelters with advertising shall not be permitted within 100 feet of anyone or two-family residential dwelling, (3 ) (4 ) Bus stop removal: Section 21-126. Application for permit required: miscellaneous building Section 21-142 (a) . (5) Indemnity to the City and the public: Section 21-147, (6 ) Assignment or transfer: Section 21-148. (7) (8 ) Denial, revocation: Section 21-149. Removal following revocation: 21-150. Section Section 4, Section 26-407 of the Wheat Ridge Code of Laws lS amended by the addition of a new subsection (14), to read: Sec. 26-407. Signs exempt requirement. from permit The following are exempt from application for permit; however, they are subject to all other provisions of this sign code: * * * (14) Signs located on a bus stop shelter for which a permit has been issued pursuant to Section 21-151, Such signs shall be limited to two (2) faces per shelter for commercial advertising purposes with a maximum of 24 square feet per face. Section 5. Safetv Clause. The City Council hereby finds, determines, and declares that this Ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and GED\S3027\133018 2 -2- welfare. The City Council further determines that the Ordinance bears a rational relation to the proper legislative object sought to be attained, Section 6, Severabilitv. If any clause, sentence, paragraph, or part of this Ordinance or application thereof to any person or circumstances shall for any reason be judged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance or its application to other persons or circumstances. Section 7, Effective Date. This Ordinance shall take effect fifteen days after final publication.
