TITLE:
AN ORDINANCE
the Wheat
Pawnbrokers.
Amending Article VII of Chapter 11 of
Ridge Code of Laws, Concerning

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, AS FOLLOWS:
Section 1, Section 11-183 (c) of the Wheat Ridge Code of Laws,
entitled Signature of Customer, is amended to read as follows:
The customer shall sign his or her name in such register
and on the declaration of ownership and receive a copy of
the contract of purchase or a receipt of the purchase
transaction, THE DECLARATION OF OWNERSHIP (CUSTOMER
SIGNATURE) MUST APPEAR ON EACH PAGE OF THE CONTRACT.
Section 2, Section 11-l83(h) of the Wheat Ridge Code of Laws,
entitled Provision of Records to Law Enforcement Agency, is amended
to read as follows:
Every pawnbroker shall provide the local law enforcement
agency, on a weekly basis, with two (2) copies of the
records, ORIGINAL PLUS ONE COPY, on a form to be provided
er approved by the local law enforcement agency, of all
tangible personal property accepted during the preceding
week and efie copy(IES) of the customer's declaration of
ownership. THE FORMS SHALL BE NO SMALLER THAN 6"x 4" AND
NO LARGER THAN 6"x 9". The form shall contain the same
information required to be recorded in the pawnbroker's
register pursuant to Subsection (a) of this Section. THE
PAWNBROKER SHALL OBTAIN THE RIGHT INDEX FINGERPRINT FROM
THE CUSTOMER AND AFFIX IT TO A BOX PROVIDED FOR THAT
PURPOSE ON THE FORM. The local law enforcement agency
shall designate the day of the week on which the records
and declarations shall be submitted.

Section 3, Section ll-183(k) of the Wheat Ridge Code of Laws,
entitled Videotaping of Transactions, is amended to read as
follows:
Every pawnbroker shall videotape all transactions, including
for purchase or
shall be kept by
NINETY (90) days

and shall be subject to police review.
Section 4. Section ll-l83(m) of the Wheat Ridge Code of Laws,
entitled Preservation of Records and Provision of Reports, is
amended to read as follows:
Every pawnbroker shall, at his or her expense, keep records or
provide reports in such manner and by such methods as may be
determined from time to time by the police department. THE
PAWNBROKER SHALL PROVIDE THE POLICE DEPARTMENT WITH A LIST OF
EMPLOYEES, THEIR DATES OF BIRTH AND THEIR EMPLOYEE
IDENTIFICATION NUMBERS.
Section 5. Section 11-184 of the Wheat Ridge Code of Laws,
entitled Identification Acceptable, is amended to read as follows
(A) No licensee nor any principal, employee, agent or
servant of such licensee shall engage in a purchase
transaction or shall enter into a contract for purchase
transaction with any customer without securing one of the
following kinds of then current and valid identification:
(1) A Colorado driver's license;
(2) Identification card issued in accordance with C.R,S,
!'l 42-2-402, which is an identification card issued by the
State of Colorado;
(3) A valid driver's license containing a picture,
issued by another state;
(4) A military identification card;
(5) A valid passport;
(6) An alien registration card; or
(7) A nonpicture identification document issued by a
state or federal government entity,. if the pa~mbroker also
obtains a clear imprint of the customer's right indcJc finger.

(B) A RIGHT INDEX FINGERPRINT IS REQUIRED ON ALL
TRANSACTIONS AND MUST BE AFFIXED TO THE FORM IN ACCORDANCE
WITH THE REQUIREMENTS OF SECTION 11-183(H) ABOVE.
Section 6, Section 11-189 (b), entitled Hold Orders and
Surrender of Property, is amended to read as follows:
If any police officer determines that any article of
personal property held by a pawnbroker is stolen or
illegally obtained property, such officer may immediately
confiscate such property and must provide the pawnbroker
wi th a receipt, case report number and/OR the police
report cover EVIDENCE sheet setting forth the basis for
the confiscation,
Section 7. Safety Clause. The City Council hereby finds,
determines, and declares that this Ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public and
that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the Ordinance bears a
rational relation to the proper legislative object sought to be
attained,
Section 8. Severability. If any clause, sentence, paragraph,
or part of this Ordinance or Application thereof to any person or
circumstances shall for any reason be judged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this Ordinance or its
application to other persons or circumstances.
Section 9, Effect of Repeal or Modification. The repeal or
modification of any provision of the Code of the City of Wheat
Ridge by this ordinance shall not release, extinguish, alter,
modify, or change in whole or in part any penalty, forfeiture, or
liability, either civil or criminal, which shall have been incurred
under such provision, and each provision shall be treated and held
as still remaining in force for the purposes of sustaining any and
all proper actions, suits, proceedings, and prosecutions for the
enforcement of the penalty, forfeiture, or liability, as well as
for the purpose of sustaining any judgment, decree, or order which
can or may be rendered, entered, or made in such actions, suits,
proceedings, or prosecutions.
Section 10, Effective Date. This Ordinance shall take effect
fifteen days after final publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of
8 to 0 on this 25th day of March ,1996, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final
passage set for April 22 1996, at 7 o'clock p,m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado,
