TITLE:
AN ORDINANCE AMENDING THE CODE OF LAWS OF THE CITY OF
WHEAT RIDGE RELATING TO WEED CONTROL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT
RIDGE, COLORADO, THAT:
Section 1. Wheat Ridge Code of Laws Article II. SPECIFIED
NUISANCES, Subsection 15-27(f) is hereby repealed and reenacted
as follows:
(F) The authorized inspector shall post properties in
violation of this section, Such posting of notice shall be dated
and signed by the authorized inspector and shall include a
statement directing that failure to cut and remove the weeds
within five (5) days of the posting will result in the authorized
inspector directing such weeds cut and the coot thereof, pluo
five (5) percent, the actual cost of the cutting and/or removal,
plus Administrative fees of twenty-five (25) percent for the
first cut, fifty (50) percent for the second cut and seventy-five
(75) percent for the third cut within the same weed growing
season, plus a ten (10) percent fee if not paid within 30 days
and a lien is assessed, to be charged to the owner, occupant or
agent or the property,
Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public and
that this ordinance is necessary for the preservation of health
and safety and for the protection of public convenience and
welfare. The City Council further determines that the ordinance
bears a rational relation to the property legislative object
sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjusted by a court of
competent jurisdiction invalid, such judgment shall not affect
impair or invalidate the remainder of the ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect immediately after
final publication.

in full in a newspaper of general circulation in the City of
Wheat Ridge and Public Hearing and consideration on final passage
set for April 22 ,1996, at 7:00 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado,
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading
